Rather than pushing for Bills which will pass only after we get a GC, why don't we ask for something more practical. I mean ask for minor policy changes rather than asking for major law changes.
Like,
1- granting EADs to all who have completed I-140,
2- reducing the timeframe to apply for AC21 from 6 months to 3 months,
This will solve a lot of people's immediate problems.
There are many people who couldn't get their status readjusted due to retrogression after filing I485, but could get EAD atleast.
What does that mean? It means by law only a certain amount of GCs can be issued in any year, but USCIS may issue more EADs based on one of their policies.

Aristotle ... I think you are new to the Forum.
It is widely known fact that Members may be even reluctant to answer the same question again and again ... but unless a legislation is passed , PD will not move.
Fact is many of us are in a bad state for the options we have selected in our lives.
There is an organization like IV which is trying to help all of us. Infact IV members consist of people whose priority dates have been retrogressed for a long long time.
Also past 2 years (yes 2 years !!), some bills have been passed in only in Senate and hence fully did not become a law.
Hopefully something will happen and give us relief. My advise , don't forget to help IV where you can.

I just received notification that my approved 140 (which got approved way back in 2007) is now moved to USCIS. Has anyone seen this before?

If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

All I have to say is .. do NOT bring parents or relatives to the US , period. Healthcare is pathetic and will rob you off tons of your hard-earned, precious savings. If you want to meet your parents/relatives, go to the home country but do not bring them here. I have heard far too many horror stories related to medical emergencies and the last thing I want is to put my parents in that kind of situation. In fact when my mother heard about the medical expenses here, she is terrifed to come here and wants me to come visit Pakistan instead, which I will gladly do.

A lot of people, including me have lost faith in IV. They are not going to pay. We don't know what IV is working on and we don't believe it can do anything. The sooner IV accepts it, the better. I have seen this personally in talking to people and you can see the evidence with less than 300 people contributing. IV needs to produce results first.

IV needs to figure out other ways to generate cash if it thinks that would help. One way would be advertising on the site. I think IV has built this website well and it is an asset it needs to use NOW. I believe IV can charge up to $10,000 a day for advertising on the website. That would be $300,000/month or $3.6 million a year. Even $3000/day would result in over $1 million. That should not be very difficult to do.

There have been thousands of instances where applicants have been disqualified from applying for GC and even their H1B revoked when initial degree was found to not be related to the occupation - examples: B.Com, B.Sc (Bio, Geology..except Physics/Math), B.Arch.
USCIS is now very strict. :( -but for the betterment of the whole system.
It goes by how requirements were specified on LC. If you put proper wordings on LC B.Com, B.Sc. are OK for EB3 .
But for EB2 they want Four year degree for Indian graduates.

Good job in starting this thread. I got frustrated like this a few months ago for the same reasons that you & the other members have mentioned here; it definitely resonates with mine. So, recently I have decided to move to Australia by applying for a PR and plan to be there for a few years before eventually moving back home.
This is what I'm doing right now:

I agree with this, we should definitely do this.
Since IV has contact e-mails for all its members, it can also send periodic e-mails on its activities, funding drives, recent achievements and ask for the members to contibute. This will be helpful for those who dont visit the site very often. For Example, recent update given by pappu inspired me to sign up for monthly contribution. But that would happen only if i visited the site very often. I would have missed it if i am not a regular visitor to the site.

I have an H1 transfer pending with Nebraska Service Centre....
My earlier H1 which was approved 1 year ago has been re-opened today...This is the status I see on USCIS web-site

Current Status: Case reopened or reconsidered based on USCIS determination, and the case is now pending.

I've noticed that USCIS has been committing some errors in updating their records. I suspect there is a virus in their system. Let your lawyer handle this. USCIS corrects their mistakes once they see proof.

In all areas, it is still honors based system - it is expected companies follow rules and laws. In each area, income-tax, police - law & order, business taxes, the way is less governance and more self regulation.
Most companies follow it in letter and sprit; some don't. It is natural and it is discounted. You are working for success not perfection in government. And this is a free country. If you can (one day), make a better small and medium consulting company. That's what it makes the country great.
Esp the Mom Pop Desi consultancy shops whose main objective is to prey on H1Bs...They should be banned.
I agree that its the lopoholes or worse - Loose enforncement that encourages these consultancy firms to keep exploiting the system.

Was your previous approval based on an extension ? [Pending LC/Approved I-140 etc] ?
Does your current transfer require documents from the previous employer ? [LC/Approved I-140] ?
Were you paid the prevailing wages mentioned in the LCA of previous H1B ? Can this be supported by the W2 of last financial year [Not the paycheck].
Did you have I-94 attached in the previously approved H1B ?
Please answer these questions it might be helpful in finding what might have raised the red flag.

Is this a parody post? How exactly is the law favorable to EB3? Just because they are allowed to file in EB2 later? Does this mean the law also favors children because it allows them to grow up? EB2 is in 2006. EB3 is stuck in 2001. "Plight"? Give me a break.
