My son joined collage this year and he been accepted as in state (California) student. I am on H1 and my family on H4.

I have an approved I-140 and can not file I-485. The problem we will be facing when the children becom 21 years old. I do not know if we can include them in I-485 or not when they become 21 years old.

    Any idea?

For me the frustrating aspect is that my first son is in college. Arizona State University is forcing me to pay out-of-state fees and have stated that I could only pay in-state tuition after filing I-485! So the money I could have invested in business is going to college tuition. Another son is in senior class in high school and will be going to college next year. Yet another son will be going to college in 2008.

I have thought of going back to Nigeria but I'll like my sons to finish college here. So, I have decided to stay until I get GC. My wife and I are both studying for Masters (another big expense for us!).

We spend most of our time between studies, volunteering and other community activities.

Could others on this forum who have college-age kids tell me how they and their families are coping with expense of college tuition?

are there daily limits for ICICILombard in case of hospitalization ? I couldnt find it any where in their site.

Yes, there are sub-limits in ICICI for persons above the age of 55 years. Please look at the policy wording, a 16 page document. Look at Page 3 in a section called 'Special Conditions'. It is mentioned there.

Those daily limits are conveniently not mentioned in the brochure, neither on the web site.

I believe it was last year(not sure exactly) when USCIS started this new initiative where the AILA members can send an email and "Remind" them that a particular case is current. Basically you will send an email with the subject

EB I-485/SEPT or EB I-485/OCT or EB I-485/DEC (Month of the VB when you will be current)

and the body will have just the A #s

    A123456789, A987654321

Note if you have multiple A#s (self, spouse etc) seperate it by comma.

    send it to
    streamline.tsc@dhs.gov OR streamline.nsc@dhs.gov

You will get an automated reply with in minutes

I not sure whether this works...but hey who cares all that you are doing is sending an email.

OR the lawyer has to send this email...very trivial question but I did not get that from your post. Thanks for sending this along...I dont know if many of us knew. Thanks again.

Alright, I was going to start the poll, but upon looking through the entries, a lot of them did go against Ben's rules, so I'm going to leave it to him and his discretion. I guess we will just have to wait.

    Thanks kubmilegaGC!

I will call the senators immigration liaison tomorrow. Hopefully she will not tell me that they cannot do anything besides what they have done because that is what they told me in September last year when I got a standard response last year.

Unfortunately nobody understands the pain and agony we are going through. For them, its just another day at the office, they couldnt care less. Nevertheless, I am going to try tomorrow.....hey, cant give up that easy.

I will call CS again tomorrow, I dont mind being yelled at and I am gonna tell her this time that I have not opened a SR. Atleast, she will then transfer my call to a IO.

Let's see what tomorrow has in store for me!!

Request the CSR to transfer the call to an IO.. thats what I did today... IO seemed knowledgeable than all CSRs I talked to...

Opened SR for my wife.. it seems opening SR for wife's case did a trick to few cases...

    Keeping fingers crossed.....

So please ask for your rights but remember you are in their country, nobody forced you to come here, and beggars can't be choosers.

Not everyone is an economic refugee and it should never be assumed to be the case or status quo. We pay taxes just like everyone else while some invest here and have a right to be represented by whomever makes decisions in congress besides we do pay taxes that goes towards their salaries and maintaining congressional offices. What would the US be like if the founders of immigrant founded or co-founded companies had decided to found their companies in other countries ? What if Google, Ebay, Intel were Russian, French or Hungarian companies instead ? Your point is not lost though, immigration is a priviledge not a right. If they deny us this priviledge we shall reluctantly leave but it should not assumed that we shall be the one's to suffer instead this economy will feel that impact. This is a global economy with many opportunities out there.

I wonder if the bashers of the H1-B program knew that :

More than 82,000 U.S. workers and professionals have completed training through programs funded by the H-1B fees as of December 31, 2005, according to the Department of Labor Employment and Training Administration. In addition, the Bush Administration recently has used the H-1B fees to provide multi-year grants to communities for training and economic revitalization. Through the WIRED (Workforce Innovation in Regional Economic Development) initiative, the U.S. Department of Labor is providing $195 million in grants to thirteen regional economies.

    or that :

The H-1B fees paid by companies have funded more than 40,000 scholarships for U.S. students in math and science through the National Science Foundation. The fees obtained from employers have also funded hands-on science programs for 80,000 middle and high school students and 3,700 teachers. In addition, more than 55,000 U.S. workers and professionals have received training through the H-1B fees paid by companies.

Here is a suggestion for you:

    1) Book a round trip ticket for your wife to fly back immediately. Meanwhile, take an appointment for your wife with a local USCIS cert civil surgeon to take the TB test/vaccine. Take it wherever you can get it -near or far.

    2) Get lawyer to draft the RFE response. Submit the doc's report to lawyer as soon as you get it. (most surgeons will give it in a day or two after checking the bump.)

This whole process should be done in less than a week if you can prepare everything else before your wife gets here.

    3) Wife flies back and continues with rest of vacation with kids. You can have your Euro vacation at the end too! :)

Downside: Twins will have to be away from Mom for a week.
Upside: Monetary Losses and life disruption cut as short as possible.

    new_phd,

Thanks for your idea....I'm trying to convince my wife to do exactly that if tommorrow's appointment in IO doesn't result in extension!

    Thanks,

bought AIG insurance..twice, my dad had severe hand pain and could not take him to a doctor, cos, the docs wont accept visitors medical insurance without a cash deposit. then i tried to get pre-certification from AIG, for which they would not give it, so its a catch 22...so screw it, even if ur parents fall sick, all of a sudden when they are in the US, take them to the emergency, there is no system in place for medical insurance for visitors, every other insurance is a scam..so dont even have any hopes..just do what u need to do..there are lots of times, this country does not allow us to live more than 6 years being on h1 without a freakin green card, we have paid lots and lots of taxes which we will never claim..so, this is how they repay.

In my opinion you are doing the right thing by reporting against your employer to DOL. DOL take their own time. But I have known a case where the employer had to shut-shop coz of complaints from former employees.

As some others have mentioned, look out for transfers with consular processing and get back here.

    Good luck with everthing.

My company got an RFE for ability to pay from USCIS. we are responding back with my companies 2006 tax returns and w-2 which shows more than proffered wage determined by Dept of Labor during PERM. I hope this should be fine and I will get a favorable response.

My concern is whether I should apply for 485 or should I wait till 140 approval to apply for 485.

    please advice

PLEASE HIGHLIGHT RE-CAPTURE OF WASTED VISAS
AND CHANGE IN THE LAW TO VISA ROLL-OVER IN FUTURE.

I think asking for increase in visa numbers works against us, especially in this economy. They may not be interested in removing per country quota too.

But, we have a genuine and strong case regarding re-capture of wasted visas. The root of this evil (retrogression) is due to wasted visas in last 5/6 years. Its quite simple math, US didn't stop/reduce H1 visas who get into the GC pipe, but reduced the number of people going out of pipe, hence the congestion.

Please make sure u highlight this one. This should be top most priority all the time.

    Dear Sir/Madam

I have been in the country Legally on a student visa and then on a work visa for 10 years. I have been in line and have applied for a greencard 6 years ago and my application has been shuttled through various departments and agencies in a 4 step procedure and now being stalled for want of a number (An immigrant number) for a highly skilled immigrant. There are an estimated 1/2 million legal law abiding, tax paying individuals in a similar situation who need your attention. All of them are in the country on a work visa and are in line to recieve an employment based green card.

The Employment based green card system is completely broken due to excessive delays and backlogs in petitions of nearly half a million highly skilled workers who are certified by US Government to be doing a job that no US citizen is willing, qualified or able to do. The delays in obtaining a permanent residency are due to 2 reasons: Numerical caps on employment-based green cards and processing delays in adjudication of files. Today the system takes anywhere between 6-12 years to grant Green cards to some of the best and brightest of the world who have chosen America as their future home.

These future Americans are facing huge quality of life issues and their employers are facing difficulty in attracting more of the best and brightest of the world due to the broken system. The system prevents these workers from accepting promotions and switching jobs for the time-period it takes to process their files. By stagnating career growth and suffocating the creativity of the most innovative and technical minds of the world.
The processing delays mock Americas respect for those who play by the rules and get in line. At the same time USCIS awards 10s of thousands of greencards to people every year outside of USA based on a pick or lottery.

At the end of 2006, there were an estimated 200,000 employment-based principals waiting for labor certification, which is the first step in the U.S. immigration process. The number of pending I-140 applications, the second step of the immigration process, stood at 50,132. This was over seven times the number in 1996. The number of employment-based principals with approved I-140 applications and unfiled or pending I-485s, or the last step in the immigration process, was 309,823, a threefold increase from a decade earlier. Overall, there were 500,040 employment-based principals (in the three main employment visa categories of EB-1, EB-2, and EB-3) waiting for legal permanent residence. And the total including family members was 1,055,084.

These numbers are particularly troubling when you consider there are only around 120,000 visas available for skilled immigrants in the EB-1, EB-2, and EB-3 categories. To make things worse, no more than 7 percent of the visas are allocated to immigrants from any one country. So immigrants from countries with large populations like India and China have the same number of visas available (8,400) as those from Iceland and Poland.

At the same time, a debate rages about H-1B visas and this gets considerable press coverage. Companies such as Microsoft, Intel, and Oracle have been lobbying for visas to bring in skilled immigrants, but have focused on expanding the numbers of H-1B visas available. Why? Perhaps because workers on these visas are desirable, as they are less likely to leave their employers during the decade or more they are waiting for permanent residence.

So we want skilled immigrants, but we want them to come on the right visas as permanent residents. The battles being fought are about bringing in more people with H-1B visasnot about those who are already here with them and stranded in immigration limbo.

Unlike many of the problems facing the United States, this one isnt hard to fix. All we have to do is to increase the number of visas offered to skilled workers in the EB-1, EB-2, and EB-3 categories from 120,000 to around 300,000 per year. And we need to remove the per-country limits. Instead of requiring graduates from top universities who receive jobs from American corporations to go through the tedious H-1B visa process, we should provide a direct path to permanent residence. We are now competing with the rest of the world for the best talent. We need to do all we can to attract and keep skilled immigrants, rather than bring them here temporarily, train them, and send them home.
One more most important aspect is also to provide an oversight over USCIS. Presently, processing delays, lost paperwork, incourteous and bad customer service and above all a non-transparent system is what immigrants face. Why should legal tax paying immigrants wait in line patiently for half a decade and pay high fees to get lousy customer service and no accountability for fees?.

    Yours truely,
Frustrated, law abiding, tax paying immigrant

My wife couldn't do TB test since she was pregnant when we filed I-485 in Aug 2007. Now she is in India and be back only in the first week of June. If we receive an RFE for her TB test ( my PD is EB3-I Oct 2003), can we request an extension for RFE? Is that possible?

    -GCisaDawg

My fear came true today. USCIS issued a RFE for my wife's I-485 TB test and she is in India right now. RFE has May 6th deadline and she would be back on June 3rd.

    What are our options?

    Request an extension for RFE?
Pre-pone her trip? (this would be really a costly option for us...since we have so much planned around that date)
Do TB test in USCIS approved surgeons in india (If there is any)

    Thanks,
    GCisaDawg
