I just spoke with Xiyun Yang from Washington Post and conveyed thanks for covering a detailed article. She expressed that there is attention being drawn by many quarters including political for "Skilled LEGAL Immigrants".
Also we need to emphasize & communicate is the "increased fees" (almost doubled in many cases) for all USCIS services effective end of this month (July 30). Is this the penalty to be legal ?
The rallys and campaigns should emphasize this important detail too. This is huge money and not fair to the amount of service that is being currently provided.

What are your comments guys ?

Why would they think like that?, USCIS made a mistake. They tried to cover (by making visas unavailable) their ass to save their jobs. Thats why we have congress to help us out.
For USCIS its a bad publicity.
I am telling you guys, the USCIS is gonna SERIOUSLY think "Lets keep screwing these guys and getting free stuff AND free publicity"

immigration-law.com also raised general concern. may be our application is sitting in janitor rooms or some inaccessible cornor or lost. But some one in USCIS has to move a$$ to find out. We need AILA or powerful congressmen or senator's one letter and USCIS will act. That's a way, Govt Agency works. unless you make noise, nothing works. Baby also don't get milk unless cry.. :)

When IV can force CIS to change thier stand and listen, we can surely take this guy to task. Please come up with some plan. This guy is poisoning the minds of the American public with "Cock and Bull" facts, it's time he is put in his rightful place.

Regarding: Inquiry/status for I-485 AOS application sent to USCIS, Nebraska Service Center on July 2nd 2007 [FedEx Tracking No. xxxx - Recd. by Mr. J. Barrett NSC At 10.25am on July 2nd]
Dear Mr. Assistant Chief,
My Adjustment of status application [I-485,I-765 and I-131] based on EB3 RIR category, was delivered to Department of Homeland Security, USCIS, Nebraska Service Center, Lincoln, NE on July 2nd 2007. It was received in the mailroom at 10.25am (reference : FedEx tracking number xxxxx).
USCIS website says NSC are working with August 2007 received AOS applications. However, I haven't heard any sort of communication pertaining to my pending application with USCIS. USCIS Customer Service would not pull up my application information in the system yet. Seems like USCIS is either not following the First in First out (FIFO) process for sure or the figures are misleading.
Details as provided below:
Name of Applicant: Name xxx
A Number of Applicant: A 088 xxx xxx
Date of Birth: xxx
FedEx Tracking No: (whatever is your tracking number)
I would greatly appreciate if your office can help me to track and process my AOS application delivered to NSC on July 2nd 2007. Please feel free to contact me at (xxx) xxxx for any additional information.
Thanks and Best Regards,
nkavjs is this the format you sent to your congressman or USCIS complaint mailbox?

Thanks for posting this I was searching for some advise on this aspect ....
I have one questions based on this comment :
If a person uses one of his I-140s and the adjustment is for some
reason denied, it appears that there is no reason why they can not then
re-apply for adjustment using the other approved I-140 providing all the
requirements are met under the petition.
So lets say Husbands 485 gets deined for some reason and the wife has an approved I 140 but her PD is not current any more, can the substiution still happen or are the couple doomed?
Please respond.

Above all I am here to get some information to bring a company which violates rules to authorities, nothing more nothing less and not here to do any name calling of mud slinging.

Folks, while reading the 485 instructions, I found that the check is to be paid to 'Department of Homeland Security'. Not to USCIS as mentioned in the very first post of this thread. Please comment.

I have an appointment at Mumbai Consulate on Jan 2 for H1-B & H4 renewal.
People who interviewed in December and have started receiving passports back - please provide information in the format below. Thanks!
Date of interview, Passport received back (yes/no), Date passport received (or N/A), Visa class, Consulate location, Visa renewal only (yes/no), Any other info. worth sharing.
Eg:
Dec 5, Passport rcvd -YES, Dec 12, H1-B, Chennai, Renewal-yes
other details: <.....................>
Below is some background info. on this recently introduced change:
Delays in Visa Issuance Resulting from the Department of States New Directive on Nonimmigrant Visa Issuance
The U.S. Department of State (DOS) instructed consular posts that approvals of H, L, O, P and Q visa petitions must be verified through the Petition Information Management Service (PIMS) before a nonimmigrant visa can be issued. PIMS is an electronic report generated by DOSs Kentucky Consular Center that collects nonimmigrant visa petition approval information from USCIS. PIMS contains data on initial petition approvals and on L blanket petitions that were approved in 2004 or later. PIMS does not contain information on approvals of extension of stay or changes of status petitions.
Consular officers adjudicating visa applications must consult PIMS to verify the approval of the underlying nonimmigrant visa petition. If the petition approval cannot be verified through PIMS, the officer must contact the Kentucky Consular Center, which in turn attempts to verify the approval through USCISs Computer Linked Applications Information Management System (CLAIMS).
DOS officials state that PIMS verification typically takes no more than 24 hours and that verification through CLAIMS typically takes two business days. Most cases involving initial nonimmigrant visa petitions are verified within these timeframes. However, we have received many reports of longer processing times for extension of stay and change of status cases. These cases must be verified with the assistance of the Kentucky Consular Center and can take longer to be processed. DOS has indicated that there are no current plans to include extension and change of status approval information in PIMS, which may result in significant delays for many applicants.
Foreign nationals who will be applying for nonimmigrant visas should expect longer processing times due to the new PIMS and CLAIMS verification requirement. How long the electronic process will take may vary from case to case. However, same-day and next-day visa issuance should not be expected. DOS projects that visa issuance will improve once the agency moves to a full online NIV application system in mid-2008.

Hi,
My labor (EB3) and 140 were approved a while ago.My company has sent H1B extension for three years in Feb 07.There was a query requesting for additional evidence from USICS in Apr 07.They are requesting lot of my company info and nothing about myself. My Company is taking its own sweet time to respond. Now I am eligible to file 485 as per the latest June visa dates for EB3.My question is could I file 485 when H1b extension is pending. My previous I94 expired on May 07.Please help as it is urgent. If the visa dates move back again then it will be horrible. My Company didn't file during concurrent filing and has eaten 2 years of my life and now they may use this to further hold me..any help will be appreciated.
Thx Vict

Ditto here. We need to give them specific case# to look into in the next phase of the campaign.
I received the same thing. A canned reply asking to use their phone lines for inquiries. They returned my original envelope as well as my letter
No responses from anyone else.
