Was your previous approval based on an extension ? [Pending LC/Approved I-140 etc] ?
Does your current transfer require documents from the previous employer ? [LC/Approved I-140] ?
Were you paid the prevailing wages mentioned in the LCA of previous H1B ? Can this be supported by the W2 of last financial year [Not the paycheck].
Did you have I-94 attached in the previously approved H1B ?
Please answer these questions it might be helpful in finding what might have raised the red flag.

Question do we have to stop working upon receipt of the denial and wait until receipt of MTR? What are work options when a situation like this occurs

Me being the primary applicant and wife the derivative are not using our H1's (I have 9 months remaining of my 6 year period and wife 3 years) I accepted a full time invoking Ac21 with the new company and joined using EAD. My wife has accepted a contract position using her EAD

It may not look as bad but this is a time to step back and take a better look on every step moving forward. This is a very testing time for the economic outcome in the next few months. A very sad episode to have come upon an Indian family my heartfelt condolence to them.

Did it say anything on your online account about RFE when you received the email, or you just got the email i.e. when you click on the receipt number it shows status of the case which usually shows a generic message that the case was received and is pending, so did that message change?
If not, then did anybody else who got the RFE had that message changed?

Yes status has been changed to : Current Status: Request for Additional Evidence Sent.

I have talked to IMG sales rep, he said they won't cover for pre existing conditions. He also said that as far as his knowledge is concerned there is no company out there that covers pre existing conditions when I asked him about it.
My final assumption is that any insurance we buy anywhere, just covers illnesses that are developed after the coverage starts.

CIS awhile back reported that they only have 60K I140 applications pending. So 125K I140 applications can't be pending..
My understanding is VSC and CSC are working on H1B and NSC and TSC work on I140, I485s.

Hello All,
I am also in the similar suituation.
Left company A and joined company B(H1B transfer approved), Company B applied for I140 using labor substitute.
But when i am checking my previous company A's H1b status it is showing 'The case is reopened'.
I am very much worried about the same.
Some suggestions will be very much helpful.

The cut-off date is determined by #485, not LC.

Because consulting companies dont necessarily cancel pending labor applications when somebody quits. They let it run through the process and use that to substitute to a new employee. If they cant use it due to this new law, nobody else would jump in front of us in the queue.
Not sure whether this will help to move PDs faster, but will help a little. At this pace, if you can expect GC in 15 yrs, if Labor substitution is eliminated you might get ur GC in 13 yrs. :( (Saves you a Whopping 2 yrs of wait time)

Guys there is no doubts if you have an opportunity like where employer is paying for the Green card process, I guess everybody should get out of the EB-3 mess. If you stay in EB3-I then you are the last one to get the VISA. If you port it to EB2-I then you put EB3-ROW behind and you get in line first in EB2-I bcoz you will have older PD.

No. It's not a typo. I had met Aman in a conference in December. He was talking about selling his house to contribute to IV (I really hope he didn't have to). But he has contributed a small fortune to this effort.

Not all professions can apply for H1Bs. You need to have specific skills that the US does NOT have. Someone on here had once posted that his wife could not work as a teacher although the school was ready to offer her a job, coz there is no H1B category for teachers. The H1B visa cannot help spouses in all professions. Hence my suggestion.
About how this will solve retrogression, IT WONT. My point is instead of trying to bring this retrogression beast down, maybe we should look at alternatives to work around it.
H1B visa CAN BE and IS given to teachers. That poster may have had the problem similar to mine and that is having spent 6 yrs in H4, she was ineligible for H1. Let me remind everyone that decoupling of H1/H4 time happened only 2 months ago. Therefore, if the lady in question already possess Bachelor degree (as min requirement for H1) and is otherwise certifiable I dont see a problem for transfer to H1 .

A lot of people, including me have lost faith in IV. They are not going to pay. We don't know what IV is working on
I believe the core group has made efforts to let us know what they are working on. Obviously, we shouldn't expect them to give us a daily update. That would be quite stupid.

If you think that with 8000 members, and 300 contributing members, you can have the congress/senate pass pro-EB laws, you are grossly mistaken.
IV needs to figure out other ways to generate cash if it thinks that would help. One way would be advertising on the site. I think IV has built this website well and it is an asset it needs to use NOW. I believe IV can charge up to $10,000 a day for advertising on the website. That would be $300,000/month or $3.6 million a year. Even $3000/day would result in over $1 million. That should not be very difficult to do.

Membership+funding+lobbying+patience = Chance of success
Sitting on our butts = Guaranteed failure
BTW, I would also like to point out the antiwar website again.
They are doing a funding drive.
On day 1 of their funding drive, 117 people gave a total of 5312 dollars.
Their goal is 70K for this quarter. And they hope to raise that money in one week. After this week, they will again ask for funding in the next quarter.
Obviously they have a HUGE membership compared to IV. But that just underscores the need for increasing membership.

Just wondering why USCIS is neither accepting nor rejecting the July 2nd application? How long can thy hold applications like this? Can they leverage this in their favour in the class action lawsuit? Is this procrastination deliberate , considering its legal implications?

I have taken my Ex - employer to DOL and USCIS and I was successful getting my money back.
If you go with lawsuit then it becomes partially a Civil case rather than criminal offense.
