This is truly unfair where country of birth determined who gets an 'Employment' based greencard before someone else. It can only be fixed by eliminating per-country limits.

We had similar problem in 2004 .Actual mess was created by VFS .Check your online status,I think you can use your passport number to track your passport. In our case passport was transfer to different vfs office .after three days they return our passport to Mumbai consulate ,this hole process took us more than week to get passport in our hand.Dont get panic...

Can you look at your H1b approval notice (i.e. I-797) and see if there was an A number (something like A123 456 789) mentioned under the "Beneficiary" box?

Hello everyone,
I was just thinking about this the past couple of months and maybe we dont even need to ask for Green cards. MAYBE our approach should be "Let the H4s work". Once husband and wife can both work, the green card can take its time. Right now the Biggest problem with most people is that "my spouse cannot work!". Maybe if we lobby for h4s to be eligible to work that may solve the problem.
Now before this suggestion creates a HUGE "Dhoom", this is JUST a suggestion. The current political climate does not look like it is going to be easy in any way to put any provisions for Green card increases. Besides if the logic is "Let temporary workers be temporary", this approach fits in with that logic, coz we are not asking for GCs (permanent residency), just more temporary EADs.
This is a blatant violation of what IV stands for. When you are asking for your spouse to work, you are indirectly saying that it is your priority instead of a GC.
So, are you just interested in making more money or getting a GC? If you are interested in your spouse working, it indicated you want to make more money. This will come at a cost of IV not being able to push the GC as a priority item.
Please analyze your requests, its impact on the organization and the morale of the core team before posting such irrelevant posts. Right now, the goal of the organization is to push forward the GC agenda without getting distracted with "H-4 needs to work request".

EB3 I is going to have a long wait. I had applied for Canadian green card and had received it. At present i have EAD and AP. Is it worthwhile to go into consular processing and work in canada or apply for a blue card or think about Australia. If this sounds okay how should i proceed.

Actually, not all he said was wrong.
We should not support what these IT consulting companies are doing with H1B programme just because we are on H1. These big companies are hoarding H1B visas so they can have an upperhand when dealing with the employees.
My own employer was trying to get as many H1s as possible without having ANY work for them.
This is also due to the fact that because even they have no work for all the H1B employees, they file for H1Bs in bulk, for they know that they don't have to pay people on bench, even though by law they are supposed to...
But most importantly we are concerned with visa recapture and GC reform in the long run..If H1B reform is the step towards that goal then that would be good..

I mostly get reds for being honest and stating the facts but that doesnt matter. I have to agree with Nathan, dont get emotional, lets see how to get out of this mess. As you stated, your employer didnt invite you, the only thing he should have done that he didnt do was recalled your petition when it became effective. He will get away with a warning and a small fine unless he has done the same as a pattern.
You can get him in real trouble, (of course but only by doing damage to yourself) by proving you paid the money for the H-1 and I sure here too, you would have given him a check and he would have given a company check to USCIS and you are going to make life more difficult for you than for him as proving you paid the money for the petitionis going to be very difficult.
This is the time to sit back and think what is your real goal. I guess, it was to come here and work hard and succeed not make life miserable for everyone involved. Trust me Honey attracts more flies than vinegar. Speak to your employers softly and try to find a solution. If you need help finding a job, I am sure there are plenty of avenues, especially with the market improving.
Now dont jump into conclusions, that I am another consultant or work for a consultant. I am neither.

how about being a monthly charge of some amount to be members who can post/respond. Others can read but not post. This way you will know exactly how many paid members you have and amount you can expect monthly

I never have and never will like the idea of being asked to pay, I give what I can unasked.
Unfortunately, the statistics paint a different picture of us "members" as a whole... and that's what needs to be addressed asap.
What of the people that by circumstance do currently not have these amounts of money to spare. I should not have to feel excluded nor should I have to explain my very personal reasons why to everyone.Of course! And for those who genuinely cannot pay *the doors are STILL OPEN - prove your commitment by volunteering. Does that work for you? Or (in all seriousness, treat this as a question that needs to be answered) - are you simply looking for a forum/messageboard?
Have you guys looked in the forums lately, people are getting "yelled" at and talked to rudely if they do not disclose how much exactly they have contributed. So we are only allowed to an opinion or help if we have money?Of course not! And I hate that "being yelled at" as much as anybody else on this forum. Which is why the concept of paid membership. Nobody asks you how much you paid/contributed in every second post - isn't that what you really want???
I will contribute when I have money to spare, however it seems I will have to leave this organization based on the comments that have been out there before I get to the point where I can afford to contribute. That goes for both time and money, some of us have responsibilities that we do not want to disclose. Like I said, you have to give some credit to the Irish. They have the chutzpah of going to lawmaker's offices in DC and say "I am an illegal...I broke the laws and overstayed my visa...please change to law to make everything ok again for me please...". And our community thinks that someone is listening to their phone conversation about how to raise money and lobby for the legal immigrants?????
I think it all boils down to how desparate we are for GCs, many people here on H1 just want to count their valid H1 visa and multiply them by thier montly savings,
but Irish and many illegals itz a do or die situation they are smart people to knock on law makers door, before law-enforcing people knock on thier doors

I am already financially/emotionally drained out due to my accident. I guess its going to be deja-vu for me again.
Now I have hardly any money in my bank accounts(around 14K to be precise), and no house , which seems to be a good news and they cannot rip off much.
Only questions I have now are:
1. Any idea generally how long these things can go on?
2. During the trial will there be any restrictions on leaving the country (In genuine emergency situations)?
3. In the worst case if I am willing to give-up my GC..would it still make sense for us(my spouse and 2 kids) to go thru all this emotional stress all over again by staying here and thinkign about what will happen tomorrow...?
One more suggestion:
1. Start withdrawing cash from bank accounts and leave the cash with someone whom you trust.
2. US can put pressure Indian counterpart to freeze your Indian bank accounts, hence don't tranfer monies in any of your or your wife's accounts.
3. Keep liquid cash on hand (not even in bank's safe deposit box)

How many core IV members have already received their GCs besides Aman, just curious?
Of late is there anything of note even happening on the lobbying front? IV seems to have become another Immigration Portal kinda website where people are now posting all sorts of info, some of it not even immigration related.
It would be nice if someone in the core team updated the rest of us, who cannot join the state chapters due to personal reasons on the website.

Personally, I wouldn't consider it obligatory to answer a specific question by someone who cannot volunteer due to "Personal Reason", whatever that may mean. If you cannot volunteer, cannot participate in IV's action items, cannot contribute, then you are most welcome to use IV's portal to get answers to your questions or get other kind of information - but do not expect updates from anyone as your right!
IV is not a top-down organization and if you think that it is becoming like Immigration Portal then partially it is due to people like you who do not want to participate but just want 'updates'.
