    What happened in your case?

    I rear-ended a car last April..The damage to the car (other person's car) was minimum (<1500) but the other driver claimed whiplash injury...They wanted 10K from my insurance (at that time that was my limit..:-( ).
    But my insurance offered them $2500 and they rejected the offer and filed a lawsuit in the county court.

    I have a deposition this month..God knows what will happen..

    But I am curious to know what was your accident about.

    What is the difference between Patriot America & Protection America other than 90/10, 80/20 option. From the comparision chart everything else looks the same. Patrior is slightly cheaper than Protection. One thing that I noticed is you can not renew Patriot if its bought <3months initially, however, Protection can be renewed. Any other good reasons for the price difference?

    From what I understand, once the law comes in to affect, labor substitution will no longer be allowed so desi companies can't sell labors anymore. But the 2nd part of the puzzle was that approved labor will only be valid for X number of days (like 45 days as originally proposed) and I am not sure if this impacts the existing labors or not. 45 days expiration may only apply to new labors but no details has emerged yet so we'll have wait and see when the details come out. If it also applies to existing labors then we are home free because after the expiry date, all labors will automatically be canceled. Well, let's wait the for the fine details to come out first.

    As for you, it appears that as long as your substitution is approved before the law comes in to effect, there won't be any problem. If not approved by that date then it's kind of fuzzy as to what will happen. If you haven't filed already, just file premium and I am sure you'll have your 140 approved before the law takes effect.

    I am not using substitution labor. I do not condone any one who does it for monetary reasons.

    So the rule hasn't taken affect yet huh! I will definitely send my application out in premium processing this week. Just worried that I have passed the 45-day time period :( . Does my I-140 have to be approved before this rule is implemented, or just that my application needs to be filed ?

    If the Repubblican Senators will confirm its vote, the Filibuster will be impossible.
    We will have 9 new senators, 7 dem, one Ind, and one repubblican.
    Except the senator from Montana, all the news dems are favorable for the CIR., as well as the Indipent one. I don`t know about the new senator from Tennesse.
    Also Kyl was talking about the original plan from Mc Cain (who will be a runner, which means that he needs the latino vote)-Kennedy, the one passed from the senate was little bit different. Let`s hope for the duck in anycase....

    you are asking for EB2 guys in 2004,2005,2006,2007 to wait for EB-3 guys in 2001,2002,2003,2004. Point is well taken. Its a humane way of handling things.

    Perhaps they should not make EB1 current, let them wait a year or two while 2004 EB2 and 2001 EB3 get their green cards.

    Ask this question to yourself. If you were an EB2 person with 2004 priority with a spouse and kid, Would you be willing to wait few more years to get your green cards so that a 2001 EB-3 shall get his faster and may not care /appreciate your sacrifice?

    Your position helps yourself and nobody else. I dont have any problems 2001 EB3s getting approved before 2004 EB2's. Thats the way it should be, but not at the expense of EB2's. Feeling of entitlement is not adequate justification. USCIS has established a way to convert to EB2 status, if you have sufficient experience. You can certainly try that option.

    I just spoke my mind, dont care if i get red dots or not. Apperantly people here are way too sensitive to an opposite point of view.

    I am in EB3 (I) with a PD of 2005.

    I agree that EB3 or for that matter any category should not benefit at the cost of another. But, when it comes to spill over, I personally feel that the numbers should be equally distributed among all retrogrossed countries and categories.

    If there are 20,000 numbers that DOS thinks will not be used in the current FY; then let it distribute equally to all categories. Say if EB2 and EB3 (I) or China gets 5000 each, then obviosuly, because of a shorter queue EB2 dates would move forward beyond EB3 does. I think this is fair.

    Whether a humane approach or a logic approach, it does not make sense for a EB3 (or any category) to wait for 7 years!!!

    BTW, I turned you green. Be happy :-)

    If you are not counted against cap, that is equivalent to visa available = PD current.

    I interpret SKILL as follows for US MS.

    1. You wait for your PD to become current.
    2. When your PD becomes current, you are not counted against the cap.

    How can we verify that my understanding of step 1 is incorrect? Thanks.

    Guys,

    Now we have poll results. What does these number mean to us? Any action item?


    All this poll proves is that new EB3 folks are more vocal. If we really need an action item then start supporting IV with money. Take part in IV action items to call reps.

    Face it other option of crying its not fare will not help us.

    Where can I find medical insurance for my parents with reasonable coverage with reasonable premium. Their age is between 55 to 60.     Came to USA on H1B, paid for the H1B fees(at that time didn't know it was illegal to do so)
    however after coming here , Paid for my own ticket and landed here on start of january 2011.

    Confirmed my arrival to the employer too. Since my leaving the home country there has not been any mail correspondence from the employer , though i have been writing many. Talked to him over the phone and he said he wasn't responsible for my arrival as he doesn't have any project for me. Waited to get another job as a H1B TXFR but stuck with trnsfrs issues due to non availablity of paystubs from him.

    I never reported to work as he said dont come to office, dont have any paystubs, but have all my H1B papers , I97 and Employment offer from that consultant. I have decided to leave back to my home country but not before reporting this blood sucker to DOL.

    I need to clarify a few things before i nail these blood suckers

    1. How long before i board my flight back home , should i send the documents to DOL

    2. I have the originals of H1B filing and LCA and I94, are they rquired in originals
    or copy to send to DOL

    3. What other documents should i send alongwith

    4. Do you think my case will get weaker if iam not here ? As i am flying back to my home country.

    5. I dont want these suckers to go scott free, so how to build my case here , can i ask the DOL to recover my wages for 4 months i wasnt getting paid.


    I do not care if i get any wages or not from them , but i really wanna see the locks on the gates of this company. They shouldn't take H1B and its applicant for scapegoats.

    Any advices are welcome to help me bring these guys to justice.

    Did you get the invitation letter addressed to the IO at POE by your employer. Why did he invite you here in the first place when there is no project.

    I have seen many of my friends doing H1 for their spouses..... while their spouces have no experience what so ever..... employers help them cook their resumes..... in these cases employee has something to hide.... so they pay
    H1 fees, stay on bench for few months......and never complain...

    Now a days many companies send people on L1 visa. On L1 you have no choice. If you can't get H1 in April you are slave to the employer.... also with L1 there is no stipulated salary like H1.... so employers pay whatever they feel like and not market rate.....but since many employees have desire to stick around in US and save some Green... pay of their debts in home country.... they stay with same employer without complaining......

    Yeah, we have to focus on long term relief. Getting AP and EAD is not a long term solution. I was hoping 'capturing unused numbers' or something better would happen with this July fiasco fix, does not seem to be happening now.

    Hopefully this DREAM act will trigger more amendments like 'no limits on STEM EB visas' to get into pending bills...

    Could you please at the same time also ask EB-3 ROW to quit this organization?

    First of all, my action just represents myself, not IV. Secondly, I don't really care whether EB-3 ROW would quit or join IV. To be frank with you, my PD is just 3 month away from the current date (EB2 China). From what I know now, immigration reform won't reduce my waiting time significantly. I have contributed to this organization, but now I decide to take some action of my own instead of contribute to this organization. It's quite funny that you threaten to quit this organization. This organization would benefit you much more than people like me since you are in EB3 ROW. But it is totally your call. I don't care whether you quit or not.

    If these numbers are correct then total EB-I pending applications are about 125K only. Thats less than one year of total quota and If USCIS work properly then this backlog can be cleared in one year (ignoring ROW for now). But thats not happening and backlog is increasing every year, especially for India.

    Howcome, USCIS reports that pending I-485 is 620249 as Jan'2009.

    Something is wrong. I wish we can get pending applications per year per category.

    Hi Folks,

    I know that with a deluge of applications, the question I am asking might not be relevent in the current scenario (July filers), but what is the historical EAD processing time? I know they say that USCIS will issue one within 90 days, but does it always take 90 days or is lot lesser?

    I remember when I got EAD during OPT, it took like 30-40 days on average. Does the same hold for the EAD for EB too?

    Appreciate your response. thanks!
