It may not be popular here, but IMHO PD porting within the same filing category can be allowed, but not retaining the same PD if you are "upgrading" to another category.
I remember one person giving an analogy of a queue in a grocery store. I would like to give a different take on it. One express line and another regular line. Lets say the regular line moves real slow and the express line is well express. However the express line slows down, but is not as slow as the regular line. The person waiting in a regular line decides enough is enough, moves to express line (by dumping the items that exceed the express line limit).
How would the people in the express line react if the person from the regular line tries to "retain" his or her position by cutting into the express line, stating that he/she was before them, but only in a different line?
If you think logically, that is the case we have here with category interfiling.
I would recommend some sort of compromise, as its not fair either to ask EB3 people to move to the end of queue, as all said and done they've been able to bargain with their employer to apply for their GC, while we did enjoy a bit in grad school, and came out with a sense of entitlement. :D
Some intermediary date, lets say determined by a mathematical algorithm (hopefully not designed by gctest) or whatever is deemed to be a fair date. But retaining the original timestamp in the regular queue is unacceptable to those who have qualified for EB2 before the one porting his/her date to EB2.
I think USCIS must meet the EB convertors somewhere mid-way to maintain fairness.
About gctest, what has pissed me off so consistently is his trash-talk, calling EB3 third grade workers, his utterly self-centered attitude and inability to see other side of the story. Over and above that he lies, cheats and changes his story all the time.

I am with the same employer who sponsored GC. Until GC was approved I was with H1B visa. Is it neccessary for me to file I-9 after GC?

He spent his money and got his H1(he belongs to a particular Indian state)...came to US with his family...ofcourse he did not have any IT skills... so after coming here he was working as a Grocery shop manager owned by a Desi guy... still on H1B.

@Alex: I like your will to file compliant. There are lot of people who want to do this, but doesn't have enough courage to even start the process. You did the first step by looking for information on how to file compliant. Since you decided to go back, I dont want to comment on other options
I saw one post on the thread by "Mayday" (its the ONLY relevant post for your initial question) on how to file complaint. Please follow that. I tried to search for more details, but I counldn't get more. Also please contact DOL (www.dov.gov, just call them, If I'm in your place I will do the same) see if they can provide any info. Some where I read that we can even complain from our own country. check that.
Most of the people in this forum are kind of "zombies".( they will get back to normal life once they receive their GC) Please ignore them.

The Admin Fixes letter campaign was a good initiative. But, the target date got moved twice, and now I dont even know when the end date is.

As far as joining a state chapter, you don't need to have face to face meetings at all. We haven't had even ONE meeting in NORCAL in the last few months.
Several state chapter members have collected & mailed to us dozens of letters without meeting us even once.
When there is time to act, you don't have to worry about how far you live etc.
The joint efforts of SoCal & NorCal are an excellent example as well. Gsc999 from NorCal has been to SoCal once in a while to help them with a Diwali Mela or a Letters drive, and SoCal folks drove to San Jose for the rally in July 07, and drona from SoCal helped us organize a Diwali mela event in NorCal in 11/2007.
More recently, rinsuper from SoCal called up hundreds of IV members all over California, then mailed us a bunch of 50 letters she had personally collected!
If there is a will, there is a way. If you insist on having a local chapter, feel free to setup yourself. IV will be too happy to help you do it!

Just a quick clarification. The time line extension for Admin fix letter campaigned was requested by various state chapter volunteers including myself, abhijit and others. The reason was the traction they were gaining after volunteering on the ground for few weeks. The idea was to leverage that instead of just ending the admin fix letter campaign on a fixed date.
Abhijit: yes, thanks to you and other highly motivated volunteers in California and other states we have been very successful in highlighting our issues to the necessary "powers that be." This is an ongoing effort and not an ad-hoc strategy. We will disclose further steps when necessary.If people want the low-down they need to be involved and go the grass root volunteer work
Fellow IVers hang-on in there. As someone said,"It is darkest before the dawn." The old members go and new members come in that is to be expected.

-- Now after more than 18 months, I get a law suit for 3.25 million dollars(. This was served against ppl who were involved. Right now my I have my EAD and AP and maintaining H1 status.
So what are my options now?
1. Check with attorney and start defending..?
2. pack the bags and go back to my country ? If so, will there be any issues in coming back again, say after 3,4 years?
3. What about my GC?
Any help would be greatly appreciated and I guess it would be a biggest decision of my life ..

Second the idea of using an ATM card for this purpose. You can get an ATM card for your parents or relatives in India from your local credit union or bank in the US.
ATM is a good idea.. What I normally do is I take or send my US check book signed of course and my name or family members name in pay to field.. No transfer fee or any thing and you can directly deposite it in any bank account with USD amount on it. The catch here is it take 10-15 business days.. but if it is not an emergency I find this is the best way and besides this you get better rate too...

A very sensible post. You dont need to have ur life around the GC and Priority dates. You need to do what u want to as much as within ur limits.. But one thing is USCIS can be staright forward and say EB-I wont move for such and such time and people can still plan better... :)

If you notice in daily life, there is always a "good-faith" disclosure of terms and conditions before signing up for anything. And both parties strive to keep their end of the deal.
That's all we are really asking from the SYSTEM - "If you are willing to open the gates for immigrants, please process their applications to the best extent possible and don't hold up our lives"
What is missing in this system is "empathy". Rules are fine and we also understand the over-subscription in certain categories. But at the end of day, the controlling or executive authorities have to show some empathy to those that are left hanging. Rules are made to help people and they should not become an excuse to punish [PR process delayed is justice denied, truly] the common folks instead.
President Obama has stated he would like have an empathetic judge on the supreme court. Likewise, we need someone heading the immigration system that empathizes with the lives of prospective PR lot.
What can we do to seek such a leader or change?

First off, any DOL complaint don't need u to be here to continue with the investigation. The way it works is, u tell them ur entire story and leave. They'd take their time to investigate using all the documentation u'd have provided them, and in the end if ur employer was found guilty, they might still let him off the hook giving him a warning. There's really no guarantee that ur employer wud be found at fault unless they find more employees lodge complaints against him. U might be the only one.
Anyhow, u can give it a shot and see what happens as u have nothing to lose. I know that ppl hv tried this b4 without much luck. Employers hire attorneys to save them from such situations. Ur employer closing down shutters is a far fetched thought...just saying...US laws are quite tricky.
H1 transfer at this point may not really work for u as u dont hv paystubs. Sorry, its a bad situation to be in. I understand u paid from ur pockets to come here and it sucks - Good luck!

Anyways looking at the LCA agreement i think you don't seem to know what you are talking about, I am here holding his company's name on my H1B form , His agreement on LCA and his employment letter, i dunno if there is any other way i could make inroads into barging into his office?
Now if he puts a security guard against me entering his office, shouldn't i report this to DOL too?

It does seem that continuous criticism has started getting to the core team.
I want to let core team know that I am 100% in full support of IV. I encourage other people who have not yet shown their support to IV to do the same. They need it.
It is sad to see people who are probably frustrated due to their situations or lack enough patience venting their anger on IV core team. I for one, don't seem to get enough time out of my routine to really do anything and really admire core team members for spending so much time on this issue which is of course of so much importance for all of us on this website.
The people lashing out at core members need to understand that IV is not a shop where you pay money and buy results. It is an attempt to take voice of skilled immigrants to lawmakers, and that is all. You should not expect anything else. Please understand what is causing the frustration and address that issue separately. Leave the core members alone.

Just because we are trying to understand a very obvious change in policy from USCIS, it doesn�t mean that we are against you or anybody in the same position as you. I talked about this IV to lots of my immigrant friends who are in different stages of GC processing. I feel those folks are thinking of getting a free ride with others contributions and hard work. I can only pity them for not being a part of the team. This kind of character would get them GC but would not get them to top in any profession. Still I did not lose my heart. I will keep on talking about IV with them and I beleive, one day they will feel to contribute.

When one switch employers using H1 transfer, the previous employer has to notify USCIS that you are no longer employed with them. The soft LUD's that you are seeing is a result of USCIS going back to the old employers and confirming that you are indeed not working with them...
Its just a procedural thing and nothing to worry about....
When one switch employers using H1 transfer, the previous employer has to notify USCIS that you are no longer employed with them. The soft LUD's that you are seeing is a result of USCIS going back to the old employers and confirming that you are indeed not working with them...
Its just a procedural thing and nothing to worry about....
