In all areas, it is still honors based system - it is expected companies follow rules and laws. In each area, income-tax, police - law & order, business taxes, the way is less governance and more self regulation.
Most companies follow it in letter and sprit; some don't. It is natural and it is discounted. You are working for success not perfection in government. And this is a free country. If you can (one day), make a better small and medium consulting company. That's what it makes the country great.
Esp the Mom Pop Desi consultancy shops whose main objective is to prey on H1Bs...They should be banned.
I agree that its the lopoholes or worse - Loose enforncement that encourages these consultancy firms to keep exploiting the system.

same thing happened with my wife's case too, RFE status change on 4/3 and then again a soft lud on 4/6 on my wife and soft lud on mine on 4/7 ... no status change... can you guys let me know once you receive the hard copy... i will update once i receive it...so far havent received and waiting for it...as we have only 30 days to respond...

I think Senior Member's should come up with some kind of a solution to this situation.
A member becomes a Senior Member with his/her 100th post. My dog can post 100 messages and become a Senior Member. Here (http://immigrationvoice.org/forum/showthread.php?t=3396&page=14) is a sample of posts that count towards Senior Membership. I will not be surprised if a large number of Senior Members have made no contributions.
On the other hand, there are members with very few posts, who have made significant contributions to our cause and act very very rationally.
In short, Senior Member means nearly nothing. Just ignore. Check their posts.

Hello All
I applied 140 in EB2 and got an RFE on Education.I have a Bachelors(3year) and masters(2years) with 8 years of experience.I have submitted an education valution with the petition still got an RFE asking to provide one with the following points
1)Consider formal education only, not practical training experience
2) State the collegiate training was post secondary education i .e. did the applicant complete the United States equivalent of high school before entering college
3)provide a detailed explanation of the material evaluated and how the evaluator has reached their conclusions rather than a simple conclusive statement
any one please help who has gone through this before

When you post about ability to pay RFE please specify your company size and how old your company is.
My employer has 2000 employees and was established very long time ago, right now they have financial difficulties and are loosing money. They pay much more then a prevailing wage. Although they are loosing money now, they\'ve been around for almost 100 years. Is the ability to pay will be an issue with USCIS?
I think maybe I should invoke AC21, to avoid ability to pay RFE?

If we had stayed back in india, we don't have have to do any of these.:rolleyes::confused: . After GC also no freedom. As one of my american co-worker was telling, In America only the statue of liberty has the freedom.
The mistaken notion "GC = freedom" seems so pervasive that I am also tempted to take a whack at this much maligned equation. Lot of anguish can be spared by keeping our expectation from this 3" X 2" plastic somewhat grounded in reality. There is no denying that having GC makes life easier than before, specifically by opening up more job/career opportunities. But these have nothing to do with the constitutional freedom that you presumably allude to with your Statue of Liberty analogy (I should say though, as a metaphor this quote of your colleague is pretty lame). Not only GC does not give us the right to vote, it cannot even protect us from deportation risk on relatively minor legal grounds (http://www.nytimes.com/2008/04/12/us/12naturalize.html?_r=1). It is perhaps wise to remind ourselves that GC is a privilege (http://www.wr.org/media/pdf/immigrationassistance/permanentresident.pdf), not a right.
Here is the other thing I do not get. What is so hard to do in the list that raises such heckles of hair loss, back-in-good-ole-days-life-was-better, and whatnot? It is all about doing little day-to-day things such as maintaining documents (that you would do anyway), or carrying PR card in your (already bloated) wallet, and other mostly mundane stuff. Hi I've been a NC victim for almost 3 years. I have heard all kinds of speculations on the real reason behind USCIS/FBI decision,like the amount of the tax you pay, your political view, your education level,etc. all influence the result. Could that be true or it's just purely a bureaucratic backlog? Something interesting to think about I guess.

This data is ambiguous from the USCIS. It very well could represent pending 140 petitions, in which case all the euphoria would turn to shock. We must try to get clarification about this before anything else.
One of the tables there mentions the NIW, that is determined at the 140 level, after that a 485 is a 485 and it goes into the EB2 queue. So when they list that in the breakdown, I suspect if they may be referring to 140s here. Additionally they list either no NIW140 or NIW-based 485s from the NSC. If they are referring to NIW based 485s, this is incorrect, since I am one of those with an approved NIW and pending 485 at the NSC. There are others like me on IV physician forum.
So lets try to get more information about this response. This data does not give the whole story. In a worst case scenario it is indeed pending 140s they have given.
The best strategy is to prepare a request that will get all the details and route it through different senators.
Multiple members from different geographical area should route the same request through their senators.
If the query result from all these senators doesn't match, we will know USCIS didn't give the proper info.
In that case we can follow up with senators for the real data.

Thanks for the excellent info on pending applications. Now we can guess why EB3I is crawling for past few years.
With regular quota of 3000 per year EB3I (until July 2007) will be cleared in next 20+ years.
