Adjustment in Dollar exchange is good for both US and Indian economy, if $ hits Rs 38, this will certainly makes outsourcing even more expensive, Indian companies which are currently overrated will have much needed adjustment and the ripple effect of which can be seen in local Indian market such as realestate etc. In a long run this is good,
for those who are still counting on saving a pot of money and retiring in India time to wake up and see the reality

I agree with the increased demand, but again this isnt a result of the booming economy all these years
This is a result of the same bodyshoppers luring these wives to a profession their MS specialization wasnt based off, why would someone majoring in Electrical Engineering need to be a QA engineer and also get
Weed out these consultants or alteast adjudicate cases carefully to clear the clogged up system

How bad it can be for those with approved I-140?
Earlier it was 140K times 7% = 9800 with everybody and now it is 90K times 10% = 9000 with most of them gone into new merit based system.
I still don't get it?
what do you mean? Who are these rest who will go into a new merit-based system? Even if you count only the number of people here who have approved I-140, that alone is enough to delay us for a very long time even with the current quota (140K). Otherwise we would not have had retrogression.

Visa recapture cannot happen with an administrative fix. Anyone who is telling you that visa recapture can happen by some admin fix or through a lawsuit is simply lying, possibly just to grab your attention. We have been repeatedly told by the administration that recapture cannot happen by an executive order.
A few days back a group of disorganized folks were writing to USCIS Director asking him to recapture. That is just a waste of time because CIS director cannot do recapture. Even Presidential executive order cannot recapture unused visas. It has to be done legislative because recapture will require change in the law.
We do not mean to dampen your enthusiasm but please do not expect for something that cannot happen. Recapture cannot happen with an administrative fix. In this admin fix initiative we are working on other possible good provisions that are possible.
I am not sure about this but one thng can certainly happen with Admin Fix.
Porting of applicant who have stayed long enough in (EB3 to EB2). EB3 15 years experience and still counting and stuck and uncertain porting rules and AC21 doesn't make sense at all.
Or
AC21 rules or some other fix giving relief to people stuck in GC unnecessarily.
USCIs can make these fixes but they dont want to do it. Its simple

I oppose the Senate immigration deal in current form.
Immigration Reform unfair to the legal high-skilled. Legal First
We are always told, Break the law, and you will be in trouble. But, the recent Immigration Reform Grand bargain proposes to send a message that is precisely the opposite.
We are being told that no undocumented immigrant will get ahead of those in backlog. While the backlog of Family-based petitions has been highly publicized, the petitions of individuals (engineers, scientists, doctors and other professionals) are being left in legal and bureaucratic limbo. About half-a-million highly qualified professionals and their families have put their faith in the legal immigration system and due process of the United States, while working to enhance the US economy. These people have pending petitions either with the Department of Labor, or with the CIS, the final adjudication of which will enable them to work with a US employer, with consequent ripple effect on the US economy.
In the old system, employment-based petitions were limited to 140,000 per year, but the proposed system, in order to reduce backlog, reduces them to 90,000 per year only! On the contrary, Family-based cases used to be limited to similar numbers, but now have been increased to 567,000 per year! In addition, close to100,000 of these applicants with pending petitions are being asked to start from scratch in the new system. In effect, it is similar to changing the rules or rather, the Laws after the fact! Innocent high-skilled prospective immigrants are being penalized due to bureaucratic delay in the DOL.
Highly skilled doctors, scientists, engineers, and computer professionals have been stuck in backlogs since the last 3-4 years. They had hoped to get relief from the Immigration Reform, but have been let down badly. They are being forced to renew their H-1Bs yearly now, while the old system allowed 3-yr incremental renewals while their Green Card petition was pending. Seems like a fitting reward for following the Laws, isnt it?
Per washintonpost report, USCIS on purpose delays the process and keep backlog to earn the extension and renewal fee as 20% of their budget. THIS IS CALLED SCAM.
Your attention and help requested on the matter.

My heart really goes out for Neelima and her family! I also faced this kind of situation in my office to a lesser extent.
I am working as a permanent employee for a company and there are very few Asians working in this company. One of the business unit is outsourced to India and in our annual off-site meeting, the manager of that business unit sarcastically mentioned in the meeting infront of all the employees, how people in India lie about their resumes and how Indians are inefficient etc. etc. I felt so angry, sad and immediately walked out of the meeting.
Sorry to hear about such cases. We all have to realize one thing here. The employers need us equally bad as we need them (more often than not, not talking about Indian consultancies here). If ever one encounters such racial discrimination and open abuse at the work place, the best recourse is to file a complaint with the higher ups in the HR, start searching for another employer and ditch the current racist employer at the right moment with an appropriate email sent to everyone detailing why the person is leaving at such an important phase of the product development. Yeah, this might sound un-ethical, but sometimes situations do demand such drastic measures to send the right message. That's when all these racist employers would realize the importance of the person that just left the company. Then they can try to fill in the position with their preferred race qualified person and see how difficult that gets!!
Better still, please talk to your friends and family in other parts of the US and find the areas in the US that are cosmopolitan and try to move to those places. Yeah that is very difficult in the short-term, but in the long-run, you would have peace of mind and a good quality of life after making such a move. Fortunately, i am in the Bay area and i have rarely encountered such racial prejudices out here. Just my two cents.
Good luck.

Hello Everyone,
I am back again. This forum is outstanding when it comes to reliable information....
I work for a reputed US Consulting firm. They under-pay you and make you over work. They market fake resumes in a polished way. YES... IT is TRUE. Don't just blame the desi consultants.
I am on a EAD. I wanted to switch to hourly basis and wanted to see if there are any direct vendors who would be ready to pay better rates. Desi Consulting Co. is out of question. From my experience, Robert Half is bad too. Is there a better way to market yourself..to the employer?
Any help will be appreciated. !!

If the amnesty bill passes, you are better off pointing immigration violation and perhaps tearing you passport and claiming being illegal
Before you tear up passport just remember that you were fingerprinted/ photoed multiple times before coming here and they can easily retrieve your records. Also if you change your names your degrees/experience will be worthless. Be careful while throwing out such comments.
Is GC worth becoming illegal? If nothing works then leave it on fate and go back. India is not a worthless country. It gives huge oppurtunities. Sometimes I think that if westerners can go there and make money then there should be something wrong with me that I am so scared to go back.

i don't think the monkey who is employed to pick out the visa bulletin that way way will be too excited about this proposition. Proceed only if you wish to incur his wrath :D:D:D:D
Maybe we need to make up a set of cards with priority dates for each EB category and have a parrot pick it up.
I think we may be able to predict much better that way. :D

What are the steps in Consular Processing and estimated processing times?
The USCIS forwards the approved immigrant petition (the I-797 Notice of Action) to the National Visa Center (NVC) if the alien indicated his desire to apply for consular processing. Otherwise, he/she has to file a Form I-824 to request consular processing; (6-8 weeks)
The NVC sends an information and forms packet (Packet 3) to the alien when an immigrant visa number becomes available; (2-3 weeks assuming the immigrant visa number has become available)
The Alien and his family complete the Packet 3 and return it to the NVC; (2 weeks)
The NVC processes the Packet 3; (6-8 weeks)
The NVC notifies the State Department Visa Office of the completed Packet 3 processing and requests allocation of visa numbers for the alien and his family; and (2-4 weeks)
The NVC schedules an immigrant visa processing appointment for the alien and his family at the U.S. consulate which issues immigrant visa. (6-8 months) The alien must attend the appointment at the U.S. consulate abroad.

With the May 09 Visa bulletin out, it should now be even more clearer to everyone that there will no progress without coordinated action. This poll shows there are at least 40 people who are interested in doing something to make a difference (thanks to those who have participated so far). Of course, I cannot believe there are not more people out there who want to step forward and make a commitment towards achieving their goal!
At the same time, I am really surprised by the lack of response by Core as well! Maybe there are not enough people in Core to be going around posting in these threads, but isn't that a problem?? I am even more convinced we need to meaningfully expand the Leadership organization and involve more people in order to move forward. It's not realistic to have the same people running around trying to do everything but it doesn't have to be that way.
Core team, would appreciate a response.
