Your case is eligible the chances are high that you'll get it, if dates remain current. And as folks have mentioned, 180 days rule applies. Your infopass will tell you clearly what's happening to your NC but that is immaterial.

Bill rate? 70/30 basis?? Contract??? I would like the OP to report his employer to DoL. DoL and USCIS will kick both the OP and the employer. It is easy to get carried away saying that the employer is blood sucker etc. But very clearly, you should know that there can't be these kinds of contracts on H1. The employer knows that people who go to them are on thin ice, and so does the employee (employer is there to do business -- he is not running charity).
Maybe you guys want OP to go to DoL so that both the employer and OP get kicked out of this country (that is good for all of us) due to obvious immigration fraud.
To top it, OP goes on an offensive when people point of the bitter truth to him. This site should not promote illegal behavior, anybody seeking advise on these topics should be severely castigated, because they broke the law too (and they know it, just dont want to admit it). Or maybe we should encourage these people to report to DoL so that all of them can be punished for misusing the laws.
While I did not suggest him to go to DOL. Let me tell you that working on hourly wages is legal on H1. The best solution is to find the job quietly. How do you know how much is his employer making and what he has got? There could be very significant difference.

Am I wrong or is there very little interest in this bill from IV - or for that matter other immigration groups?
I understand that its going to be hard to get ANY legislation passed over the next couple of quarters, but I think getting behind these inital ones will lead to a growing momentum. This momentum is what will eventually lead to any immigration changes..

But in the poll, 56% of Republicans earning more than $75,000 annually would "strongly" or "partially" agree with candidate who would bar illegal immigrants from path to citizenship.
Look at this. Even when the conversation if totally on "high-killed workers", there is always and has to be always, a line or a sentence about illegal immigrants. Somehow, you cannot discuss anything about anything unless you have one line about illegal immigrants. The only sensible reason to discuss illegal immigration in same topic as "attract and retain" the "high-skilled workers" is that if there are people who are high-skilled, need to be "attracted and retained" and also happen to be "illegal".
So folks, look around yourself, do you find anyone who is "high skilled", "illegal" and also need better laws to be "attraced and retained". NASA folks and folks from silicon valley, please check the cubicle next to you to find an illegal rocket scientist or an undocumented microchip designer. While I am happy for you and your success along with your spouse, I personally consider it as being at the right time in right places making decisions that were in your reach. I do agree that you did lot of planning. Most of the people here run on one income and spouses on H4/F1. So they dont have the edge you had/have. I might sound harsh in saying this but the matter of fact is that the 2 incomes lead to savings which lead to buying a home(s). 1 income, you wouldnt have done all these by yourself. I know several people with 2 incomes and most of them have done this :) Those who havent were the kind of folks who are happy having their 100K in bank rather raking up 200K in equity. I am sure there are a lot of things you can do with a US Citizenship.
IMHO, you are succesful in your own way depending on the situation you were in and how conducive the circumstances were. I feel that this forum is totally going in a direction where people are seeking some sort of solace in discussing stuff that doesnt directly relate here. Now that all of us had discussed about what we can do with a GC can we streamline our effort to what we can do to get a GC.

my priority date is jan 2003.first ours was at TSC and then it was transferred to VSc and now it was transferred to TSC.
Take all the options available to you ( congressman, ombudsman, senator, calling USCIS and infopass appointment)
You may also ask your attorney to send a letter USCIS through AILA - liason office.

I fail to see what is unjust about this. They move unused numbers from EB1 to EB2 because it works this way.
EB1 -> first level of preference
EB2 -> second level of preference
EB3 -> third level of preference
Now are you saying they should skip level 2 and drop some unused numbers from 1 to 3 directly? Why? That would actually be unjust.
To be fair, the US immigration system cannot be blamed because a lot of us desis have entered the queue.
it depends on who is in which category ..I feel the above (1 -2 -3) is unjust ..not that I/we can influence how it flows. my view is that the category which is at the end should get more visas ...and I would support this even if things change tomorrow (EB3 current and EB2 severly retrogressed or EB-wwide - retrogressed ..not that it will ever happen !!)
