Caliguy,
It is interesting......why does congressman/senatorial inquiry works for some and not for some. What can we do differently. I sent out a "Thanks...but no thanks" email back to Congressman's office.
I mentioned that I expected that a congressman's inquiry will at least make TSC to look into the case and do a due diligence but not throw the same reply that they'd to individual inquiry.

So if I do an H1B transfer to another company, there is no way to file a dependent 485 application for my future spouse?

Thats within the June 01, 2006 cutoff for EB2 India.
Yes , but Mar 06 is beyond Apr 04 for July 2008 dates, so,indeed there is traction this month!!!!!, that is why it is interesting

1. If I-140 is not yet approved and withdrawn, you lose I-485/AP/EAD.
2. I am not sure why they cannot file a second I-140 based on PERM LC right away. Seems to be a no-brainer to me. Must be one of those lawyer things :)

Q: Is it possible to file two petitions, such as an EB-1(a) and NIW, at the same time?
A: Yes. Some of our clients file two I-140 petitions simultaneously. Some clients file three I-140 petitions at the same time. There is nothing stated in the law that prohibits multiple filings. Multiple filings increase your chances of approval.

I think the original question could be rephrased as follows:
Will I get an FP notice if my PD is not current?
Would someone answer this question, please?

These people are worse than any bad people. They dont deserve flowers.
chandu, I agree with you. They definitely don't deserve flowers. They deserve a pile of **** - you know what. Although I did send flowers as per IV's directive I am not Gandhian. I think Gandhian philosophy only works in movies and books. Although this is very controversial and I might invite the wrath of many on this board - but hey I am entitled to my opinion :D - Peace

I think its good idea to try to add just one demand i.e. I-485 filing provision without current priority date into Supplemental resolution bill. But I think it will be really nice to try to get ability to change employer without waiting for six months(after filing 485) into the bill also. So that person can invoke AC21 without waiting for six months. I think both of these provisions go hand in hand.
Does anybody know when the next session is starting and when are they going to start discussing this bill and when will we be able to find out if our provisions are there or not?

Well they will ask for police clearence form every country where u have stayed for 6 months or more after age of 18.
So if he/she stayed for less than 6 months in singapore then its not even needed
It is more than 6 months...and they started asking for Singapore Police Certs in early or mid 2005, before that they would check those out themselves..they may well still do that but ask for them inadvance now.

The only thing USCIS can do without regulation...is issue Public Notice
How funny, right?
or take back one of their Public Notices....the ony thing they can do, is take back the Public Notice - that 485's will be rejected.....

My current EAD got expired by 08/27/2010 and I filed my extn by 07/06/2010. My check has got cashed by USCIS with in a week period of time. So I thought would get my EAD asap. But it didnt. Since my EAD extn filed to Nebraska Service center, called them on 1-800 and spoke with one of their representatives to expedit the process. I got a reply back from USCIS that they will expedit the process and the result should notifiy by within 30days.
I already in LOP, I dont know how long the process will take..? If anyone knows how could I do better, please let me know the details.
NOTE: Seems my priority date is also became current (Mar-30-2006). Would it cause for the delay..? Will they provide EAD and GC simeltaneously...? or Will I get EAD alon..? or will I get GC...?

I agree that car depreciates as soon as you drive out the showroom but what I believe is that if you can afford to buy your dream car and plan to keep it for atleast 7-10 years go for it. Life is short, if you can enjoy luxury and at the same time know your limits don't restrict yourself and drive used cars all your life.
As far as your home mortage is concerned, talk to your banker and negotiate favorable terms. If you plan to live in that city depending on job market, don't worry about home prices. I hope you did not buy that home to make money overnite but to enjoy the luxury of living and owing a home. In any case, don't plan to put money on home, better to save or invest where it makes more sense like stocks, CD's or land/home in India.
I donot see any point in paying off the house, as you can deduct the interest to get some tax benefits. Why loose any benefit you can get.
On the other hand, use the money you were thinking of paying off the home for investments. Investments may it be CDs or stocks ( though right will come in future).
Although personally i have never bought a brand new car in US. Car depreciation is biggest loss one can take; we just bought a 5 th car...all cash paid and it is used.
Keep your cash, play with 20-30% based on your risk apt, donot pay off your home...cash is king.
On your comment of " being a novice in financial "...i have to say it Everyone is a novice in every matter, we all learn it here. Rather one who says he/she is a novice will make cautious decisions; i am wary of so called experts/gurus who mauled financial markets and still call themselves experts.

Exactly but mere emphasis solely on educational qualification is unfortunate as after few years in job market, your skills & experience has more leverage than the degree and I am saying this based on my personal experience. In our group I was the one with least amount of formal education but still I got promoted 2 times ahead of Masters degree holders form US and foreign universities.
The issue here is, USCIS is a government agency. They are incapable of making a subjective determination of a person's capability. All they go by is the degree certificate which can be seen on a piece of paper.
As per INA/USCIS, many of the following won't qualify for EB2:

Sorry everyone I have been off-line for 3 days now. Someone's dog chewed through the cable line and I couldn't get on. I'm at school right now. Should be fixed tonight.
Thx Pom. I wish I kept most of the layers. Cause if you look at it now there aren't many. I merged most of them to keep the file size down. If I hadn't you might have been able to see more.*sob* oh well....thx for the nice comment...

The doldrums of August continue on Capitol Hill. Congress is out of session and so there is little visible progress to report on the immigration bill. But that doesnt mean that there is no news at all. We are still getting indications that the Senate and the House are engaged in quiet negotiations over the framework for a compromise and there were news reports this week that the White House has also been working to encourage a deal. It still appears that the "triggers" concept could be the answer. The idea that has been promoted by several in the GOP is that the legalization provisions in the immigration bill would be delayed until after border security measures are put in place. Expect things to heat up in September.

Anyway having + Attitude and is good thing.

Can some one with good english skills prepare an email with heading like
'Please approve my status from legal to ILLEGAL.' include all points from rajesh_kamisetty and any other similar questions.
And everyone in this forum can send that out to every newspaper and every senator in this country. I believe this can open their eyes little bit.
Think guys. If there is decent letter I promise that I can stay whole night to send to all these guys.

I went for consular approval last year. At that time I had applied for LC. The form had the question Have you ever filed an immigrant visa petion, or has an immigrant visa petiion was ever filed on your behalf? My attorney told me to say No.
USCIS has F1 file. Why did they not reject I-140?
They cannot reject...I thaught I exaplained it clearly enough....

dont worry about actual salary being higher than LC salary.
i had the same issue last year...my bonus put my total salary over $50K than what was listed on the LC. i checked with my lawyers and they said that was fine.
Just curious - Have you heard of a case being rejected just because the salary was higher than the original LC ?? (Assuming job title/description are same or similar). I think it will be almost impossible for them to reject just because is higher!! Govt. cannot dictate the upper limit of salaries (in private sector).

I am in the same situation right now, called both SFO and SJC airports and they seem to indicate they do not know anything about it. DVB how did you handle it ? Also, will it affect my status being on expired I-94 ?
