Whatever side you are on. There is no way you can liken kamikaze mission to a suicide. Kamikaze mission was of bravery, people willing to die for their countries -- that is the ultimate sacrifice. People committing suicide are just cowards who aren't strong enough to face life problems thrown at them. I am sure a lot of us here have lost investments too, but we are going to pick ourselves up and continue to make our lives -- not end it.

What will be my status after i file my I485?
My current I-94 will expire on 16th Sep 2007 (on the day my current visa stamp in my passport expires and my current H1 B is set to expire Mid April 2008).
I am planning to make a trip to Cannda or someplace to get a new I-94 as soon as i get my new passport (i had sent it for renewal on june 2nd). But i am a little worried about my status if i am unable to make the trip.
So my question is what will be my status after 16th sep 2007 (once i file for I485 (first week of July2007) and my I-94 expires on 16th Sep 2007)?

After you file 485 you are in AOS so you can file for AP and use that to get back into US. Once in AOS it doesn't matter if your H1B expired or I94 is expired as you will be in status. However to work you will need EAD.
To enter reenter US you should have a H1B visa stamp which is valid or have an AP. If you use your AP you will have to use EAD to continue working. Another option is to get a new H1B stamp based on your current H1B petition which is valid till april 2008.

Whoever opened this post about retrogression, close this stupid post.
Previous months everyone was discussing on how the dates should move, how to avoid retrogress.
Now when the dates have moved, now some idiots are speculating on when and how the dates should retrogress.
Guys get a life, focus on the core element here, the element is to relieve ourselves and others from backlog. Read all these posts, what are we you all focusing on when dates will Retrogress
What you get in life is what you attract and think. Think positive and positivity will come to you, if you keep questioning it, then you can join the long line of suckers and whiners.

My I485 is pending, recently I have changed my address online. I also recieved confirmation letters for this address change.
After 2 weeks of address change, USCIS issued an RFE. I have not yet received it, but I just want to prepare for this.
What could be the reason for this RFE? Is it common?
People here have related change of address to RFE but I personally do not blv. it happens as I changed address 3 times and nuthing adverse happened.
Wait for the RFE. It could be something minor. Since you are eb1 they might need something related to your job/experience. Each RFE is different and no one can predict what it could be. I have seen that 80-90% RFE can be replied easily so dont worry. Post again when you have information on what USCIS is asking for and I am sure that somone out here will be able to help you out.

Hey Everyone,
My brother is a US citizen who has filed an I-130 for me and my family in May, 2008. We've traveled to the US on B1/B2 visas in February, 2009. The thing about it is that in the DS-156 form point "36. Has Anyone Ever Filed an Immigrant Visa Petition on Your Behalf?" we've answered "No". I've had no idea at that time that it was referring to the petition for alien relative. Anyways, we've returned back home in time. Also, I've had 3 visas before (2 tourist and 1 student) and never violated any immigration laws.
Then in December, 2009 we've applied for F-1 visa and got denied. This time it was a DS-160 form that we filled out which replaced the old DS-156 form. It didn't have that question about the petition anymore. I think they've decided to exclude it because a lot of people were confused by it. Anyways, the consulate officer didn't like the fact that I haven't transferred my credits from 2 courses of University that I've completed in my home country. Plus my major differed from my previous education course.
So my question is. Is it ok to apply for F-1 visa while I-130 is pending? I mean we've been issued B1/B2 visas before. Even though we've answered "No" to that question, they saw that I had a brother in the US who is a US citizen. I'm thinking of transferring my credits and using same major course this time or at least similar. This way in the eyes of the consulate officer it will look as I am going to the US to finish my education. The thing is, I am planning to attend community college first in order to finish general courses and then transfer to the university. My major in my home university was physics and this community college doesn't have it. I may go with "general education" course at the community college and explain to the consulate officer my situation.

I was just thinking if it would help to gain more publicity if this site goes by a different name. On several instances while calling lawmakers or other people, the moment I mention immigrationvoice.org they think it is related to Illegal immigration / CIR etc. I need to stress that it is about legal immigration.

I was in your situation during my GC process. I was in EB3 queue going nowhere, but waited for couple of years. When my division sold out to a new company, I was promoted and with the new job, I could qualify for EB2. I then port it from EB3 to EB2 and with the wait really proved to be fruitful.
GC journey has lot of ups and downs like any journey in life need not get frustrated regarding this. Find various other avenues and ways to get over with it!

So why do you care? Do you intend to stay past your 'visa' expiration day in the first place? Good to know though.
The question though is do they use the actual visa expiration date or your status expiration date? Considering the fact that you can have a visa valid for 2 years but still be in status longer than that period.

2. Reverse Brain drain impacts.
3. Outsourcing economies gaining edge because of Americas poor legal immigration policies.
4. Delays in normal processing.
5. Impact of Backlogs on America competitiveness.
6. Impact of Backlogs on immigrations careers and their contribution to the industry.
7. Details of Presidents State of union Address for legal immigrants.
8. Statistical details which have shown immigration does not affect Americas growth but helps growth of America.
9. Requests of immigration voice.
We quoted our personal life experience and the hindrances we encounter in our career growth.
I have to say the points were observered with a positive note. and the staff said that these will be conveyed to the Senator.
He also suggested, to contact the media, which we are doing and also told,
he was also aware of immigration voice and its good doings.
He also told the Senator voted in favour of CIR 2006.
He suggested having a direct meeting with Senator would definetly help, as it would have a better impact, but he said that it would be easy to get an appointment of the Senator in DC. At this point, we have requested the immigration voice DC members whether they can have an meeting with the Senator and we can arrange the same with this staff member.
He also requested, if any of our member are meeting with the same Senator office staff in different location(Detroit, Grand Rapids,Escabana etc), please refer this staff name for continuity reasons.

I will be sending a Thank you letter soon to this Staff.

Thanks, But how would I know the case number? Because it was filed by my company and I dont have any clue.
Also do you think there is any value in at least getting total number of LCs certified, by date and then basing our assumptions by proportioning how much each category is retrogressed? The SOC code is the one you use to ensure same or similar per AC21. You can get the descriptions from the SOC classifications. Just Google SOC job Classification and you should get it.

Maybe I am missing something here but the green card for this beneficiary was started in 2005. The PD of 2000 is due to a labor-substitution. Aren't those the facts here?
I was referring to the whole inefficient, time consuming immigration process. One does not know how long folks who missed the AUG 17 date have to wait!!
