What is the benefit of applying for an OCI card for the kids and how long does this process take?
the kid does not need a visa to enter India. Also, if you go on a visitor visa, then your stay is limited to 180 days at the max. On an PIO you can stay how ever long you wish to, but after 180 days, you need to register with the district police station to get a certificate of extension. this is usually valid for about 2 years. you can renew that every 2 years.
If you are on an OCI, then the above restriction on PIO does not apply. You have all the prvileges of an India citizen, except that you cannot vote and hold agricultural land.
I am not sure about sutdying at Indian citizen rate. You might have to pay the fees in USD, if i am not mistaken.

Pre-Adjudication is just a work flow method and not a policy. There is a high chance that a pre-adjudicated case may just get an approval when the visa numbers are available. But, who knows, they may have reasons to still issue an RFE requesting employment verification based on certain triggers such as change of address, over a year since case was pre-adjudicated etc.
So we may not be able to say for certain that all Pre-adjudicated cases will be approved when visa numbers are available.

Use a competent attorney. Do not try to handle this yourself. I am sure that you have heard of "you get what you pay for"...
BTW, are you one of those cases with a 3 year degree + Experience, working in IT? If yes, the I can see why your I-140 was rejected. Lot of people have had this issue, but I do not know how many have successfully been able to resolve it.

The OP claims his 140 was approved. If they went back and rejected his 140, without request from his ex employer - this would be the first time I am hearing such things happening.

Not entirely true, I switched job a couple of months ago - filed for AC21. I got an acknowledgment from USCIS for the same - stating that it will be added to my file, to be reviewed when my application is processed.

This whole spelling bee thing is the stupidest thing I have ever heard of. By any standards, it is pure and simple torture to subject the kids to memorizing thousands of words and their stupid spellings. And what use is that? Have they never heard of something called SPELL-CHECK in Microsoft Word and other email services ?
Or are they afraid that their kid will go to a job interview and someone might ask them to spell the word that no one on the planet ever uses and is only present in the Oxford Dictionary.
Those who subject their kids to such a regimented, rigorous, scripted childhood are preparing a next generation of work-force that would only know how to follow the orders and accept directions.

What that tells you is that too much education and scholarly childhood increases your job security, in that sense that you will never be unemployed, but it decreases the chances that you will be on the top or you will be a billionaire.

Finally, a look at GM and Ford history from 1920 to 1940reveals the reason behind a need for a better risk assessment.
I don't see why everyone should strive to be the richest person or C-person in the world. Everyone has different value system. Some may like 9 to 5 job because they can enjoy other things in life... like lying down on beach, watching your child take first few steps, etc. Some moments never return in one's life.
I work with different Managing Directors, they earn a decent $250+ salaries but none of them even want to become CEO or for that matter any C-titled manager. I know one MD, in early 50s, who passed the C job because he wanted to go fishing with his 4 sons at his vacation home in New England... At that time he told me, "Once these bastards leave me I guess I will cherish spending time with them fishing at my vacation home more than counting big dollars in my bank account".

I hope it does some good to you and makes your PD current/closer so that you dont eat/sleep/drink VB. C mon man... There are other things you can do. Dont get offended by what I am saying. If your PD is closer, I can understand your excitement. But a lot of people are just killing time in forums by working their ass off on predictions and call it comic relief. I beg to differ.. My PA DL is based on my Work Visa, hence it expires on the day my visa expires.. I tried to renew online and the system said since you are not a citizen u have to go to the DL Center for a renewal... Maybe your DL is from the time you were student or otherwise...

This is not true. The Indian citizenship rules were changed sometime in 2003 so that children are not eligible citizenship if the birth was not registered within 1 year or if the child has taken some other passport. These children can get Indian citizenship only after attaining 18 years and renouncing the foreign citizenship.
I think like many Indian government rules, the OCI rules have not been thought out properly.
But within a year you can register a birth and get Indian citizenship, right? Whats stopping you from registering birth within a year?

I don't know if this question has been asked before. Is there a benefit for filing AP by paper rather then electronically. I filed EAD by paper to TCS and got the "Card Production Ordered" email yesterday (in 14 days) for myself and my wife. My friends who efiled just received finger printing appointment notification and no receipts. Is there same benefit with AP? Please calrify.

EAD: This document proves you are allowed to work in the United States.
Renewal EAD: You should apply for a renewal EAD six months before your original EAD expires.
Replacement EAD: This document replaces a lost, stolen, or mutilated EAD. A replacement EAD also replaces an EAD that was issued with incorrect information, such as a misspelled name.
Interim EAD: If USCIS does not approve or deny your EAD application within 90 days (within 30 days for an asylum applicant; note: asylum applicants are eligible to file for EADs only after waiting 150 days from the date they filed their properly completed original asylum applications), you may request an interim EAD document.

I dont think USCIS is thinking that way. They are just picking a stack of application ( mix of all EB1 2 3 for all nationalities) and validating the applications to see if anything is missing or if there are potential reasons to deny it. If they can deny it they will do it promptly and that is one less case to be shown as pending. If they need additional info they will issue RFE and get updates. If they feel satisfied they can pre-adjudicate application and claim that count in their yearly review as acheivement.
Preadjudication is done to maximize visa utilization and avoid rapid movement of dates. DOS moved dates in July 2007 to maximize visa utilization keeping CP applicants in mind, but did not have a count of AOS applicants.
But the fact with EB is most applicants are AOS as compared to CP.
By preadjudicating they are able to have a count upfront to hit the CPO trigger.
Now when your dates become current, the officer may want to review your situation again or may not - this is pure speculation and is a possibility.

I am planning to write to Indian Ambassador (Meera Shankar) and complain about this less preferential treatment to Indian citizens by Indian government for OCI. I suggest you guys do the same.

They hushed up and approved my EAD in 20 days. Why ???? 'cos So they don't hit Jun'30 and give 2 years. They wanted to milk another 680 from me so they hushed up and sent me the 1 year EAD in 20 days.

Agree 100%. Atleast when Bush was in office there were bills introduced that encouraged skilled immigration Eg: Those who have been around for a while would remember the Cornyn-Kyl bill from 2005.
Everybody likes to talk about the Clinton era, but don't forget that Republicans had majority then. So we may see good things happen after the November 2010 elections if dems lose majority in both house and senate. And it will be good for Mr.Bamster to govern from the center going forward than to hang out with the far-left, may even fetch him another 4 years.
