All your friends who got 221G are not telling you the truth. Was all their paperwork complete and ok? Probably not. No friend will admit their mistake and fraud. So they are telling you half story and blaming it on others. 221G is a good thing. It shows government is looking at possibe fraud and security risk seriously. National security is very important and highest priority for us living in US. H1B visa as a whole got a bad name due to fraud. It is not just employers but employees are also responsible for it. Employees are not illiterate or dumb to not understand any fraud. I wish more serious work is done by the government on every greencard application. If the system has clean cases, no anti-immigrant will point any finger and say the whole H1B system is bad.

1. If I-140 is not yet approved and withdrawn, you lose I-485/AP/EAD.
2. I am not sure why they cannot file a second I-140 based on PERM LC right away. Seems to be a no-brainer to me. Must be one of those lawyer things :)

Was it covered by any insurance? or any method you can suggest to let insurance cover it?

TB, XRay and Physical was 150 $ for me. Since I had (and you should too as USCIS send a sealed envelop of the medical exam) previous medical exam they were able to get the immunization records from that.

I am still waiting- applied May 1 eb-2.
NSC is now a Premium Processing Service Center.

I am on the same boat. My 485 was approved on 8/6 but no card yet. I have opened an SR. My approval notice says that I should receive my card within 3 weeks but the automated message at USCIS as well as the customer rep there says that I should wait for 60 days. I insisted on opening the SR since the approval notice clearly says I need to contact USCIS if I did not have my card within 3 weeks. I was told that I would get a response within 30 days for my SR.

You still have 9 months to either get your employer to apply Labor or find another job that does.......If you cant..its not the end of the world....Enjoy your time here...start applying in India..... They do not care about greencard on H1B thinking that it will come whenver the company applies until it is too late. They enjoy the first 3 years of H1B enjoying America and dollars and do not bother about IV or advocacy or contributing money to IV. I have seen such people even telling others it is a waste of time and making fun of IV. After 3 years they renew H1B thinking that they still have 3 more years. But once 6 years are about to expire they worry that they will have to leave US of A and the land of opportunities. It is at that time they try to start greencard process and check out IV. These same people then start contributing to IV and take this effort seriously.
You still have time of 1 year and 9 months and that is good enough to get your labor through. Good luck and hope you find help from people here.

When they approve a case then status clearly says 'Case Approved'.
The email "we mailed the document to the applicant" may be anything or nothing, like if they transfer ur case to different service centre, they send a notice. Some time they don't send anything even though the email contradicts it. Keep checking the status, they might update it later if the case has been approved.
Also, for AP keep bugging ur attorney to see if they got it. For EAD, make sure your mail box has your name clearly, otherwise they won't deliver it.

On the I-485, the question regarding any memberships or affiliations I had was left blank.
My PD is oct 18,2001 which will be current from April 1.
Im expecting that they are working on my case now :)

belive it or not, I knew that. I mean the part about the US, not the part about India as I don't hail from there.
The point that I was trying to make but did not state clearly enough was that I feel that when one has a political agenda whether it is pro or anti immigration, children should be kept out of it. Labeling children like anchor babies is dehumanizing. I believe that when kids are involved, as human beings, everyone should always be concerned about their best interest rather than what our political view.
This is why I hate the term anchor babies. The antis are willing to even dehumanize kids if it fits with their political view.

You work for Govt on H1b. Payment would not be an issue. The only issue could be experince certificate. They might ask you to provide experience certificates.
NSC is really crazy about RFE. They complan about resource and they have time to issue RFE. 99% RFE's are cleared on first response.

My I485 is pending, recently I have changed my address online. I also recieved confirmation letters for this address change.
After 2 weeks of address change, USCIS issued an RFE. I have not yet received it, but I just want to prepare for this.

Wait for the RFE. It could be something minor. Since you are eb1 they might need something related to your job/experience. Each RFE is different and no one can predict what it could be. I have seen that 80-90% RFE can be replied easily so dont worry. Post again when you have information on what USCIS is asking for and I am sure that somone out here will be able to help you out.

(C) The travel outside of the United States by an applicant for adjustment of status who is not under exclusion, deportation, or removal proceeding and who is in lawful H-1 or L-1 status shall not be deemed an abandonment of the application if, upon returning to this country, the alien remains eligible for H or L status, is coming to resume employment with the same employer for whom he or she had previously been authorized to work as an H-1 or L-1 nonimmigrant, and, is in possession of a valid H or L visa (if required) and the original I-797 receipt notice for the application for adjustment of status.
Looks like we can ask for a receipt notice in case we are travelling out of the country. Atleast ask!

I am also from south east michigan. I don't any see posting in this section, which surprises me. We have to mobilize our friends in this region as Michigan Senator is going to hold a key position in the new congress.
Thanks for signing up on this thread for MI chapter. I am surprised too that overall only few members have volunteered. we need to really get more people at local level to help out with IV activities. pls. contact your friends to sign up and spread the word.
