Hi guys
on weekend i got email abt my I140 has RFE.Message saying they mailed on Nov14.i am expecting letter to attorny or emplyer in 2 weeks.
My pd is 2002 Dec. and my Company got merged last year to new company, i have 3year degree and 1plus year diploma which is equal to B.S computer science, when my employer did Education Evalution.
I am expecting 2 Queries
1) when company merge they may ask Company tax returns for current year.
2) or they want again Education Evalution

It makes no difference whether they allow concurrent filing of 140/485 or not IF YOUR EMPLOYER IS WILLING to pay extra premium processing for 140. IF not , it makes minimal difference (2-3 months delay). Earlier this year, people were getting 140 approved on 6-8 weeks on average without premium fee.
If your date is not current:
This rule makes 0 difference. File 140 and wait for approval while your date moves forward. Once its current, file 485. So everyone who is retrogressed, this rule makes no difference to you 485 filing and getting EAD/AP.
If your date is current: File 140, regular processing 2-3 months and then file 485. If you can get premium processing done then it would be 15 days and then file 485. Either ways, you are delay in filing 485 by 2-3 months. In the grand scheme of things, its negligible. It would take even 2 months for your lawyer to get the paperwork straight for filing 485.

And its good as long as revenue stays in USCIS as they do need revenue to hire more people to process files faster, which is in our own benefit. I agree. Aware members need to inform ignorant members obsessed with notices on other threads and stop those therads NOW. We have tolerated such threads enough. I am not joking, you will see from today new threads of EAD and AP trackers for the next 6 months. So let us all nip this in the bud in the interest of this organization. What do you think?

It's not a tracker and I'm not tracking or looking for my receipt notices to come from USCIS or my checks to be cashed or anything like that.
My notices have already arrived and my lawyer and employer are refusing to give them to me. I have foreign travel planned in October and I might be looking to change employer soon. My question was whether I can invoke AC21 without having the physical receipt notices.
Would be helpful if someone knows for sure.

Thomachan 72, if you have already submitted a non avialability birth certificate, if you submit a birth certificate then will the immigartion not question as to how do you have a birth certificate now.

Thanks, But how would I know the case number? Because it was filed by my company and I dont have any clue.
Also do you think there is any value in at least getting total number of LCs certified, by date and then basing our assumptions by proportioning how much each category is retrogressed? If we can actually get the real number and then making certain assumptions might still be more realistic than now when we dont know anything about how many LCs are in the queue. We might as well assume that those whose prority date is on or earlier than the certified date are approved (even if they are not) because they should be getting approved in a few months time. Especially EB3-I as I dont see rampant jumps in the priority date, you know what I mean?

The SOC code is the one you use to ensure same or similar per AC21. You can get the descriptions from the SOC classifications. Just Google SOC job Classification and you should get it.

IV is in touch with USCIS, Admin officials as well and continuing our efforts with lawmakers. A year ago it was difficult to imagine. We have covered lot of ground in the past one year and this year due to the support of all our members we feel very motivated. Visa bulletins are very negative and let it be an inspiration for all of us to work harder to get rid of retrogression.

You should make sure that your employer is willing to support you. I dont know what kind of employer you have so cant speak about it. I moved to EAD and my employer fully supports me........be it 140 be it h1b or w/e. I have always helped him via sending people to join the company and now its his turn to give it back to me........so one has to evaluate his situation and then deicde.....

even my employer didnt allow us to file saying, if employee files, FBI will get mad thinking it has toxics in it :D :D :D

If i change to a different job profile (engineering to marketing; in the same company though) obviously, AC21 cannot be invoked. am i going to lose the current benefits of I485 (like EAD and AP) while i file for a completely new LC,I-140 and I485?

I was told that Sen. Pelosi did not directly endorse the bill, but she is fine with amnesty bills. I think we may finally see something cooking. If we don't, then chances are we need to wait till 2009 !!

I am also in the same situation, My (including my wife) I-485 case was approved on 8/5, my wife received physical card 2 weeks after and I received a FP notice (Code 2) and i gave my biometrics on 9/29 and my I-485 status changed from Approved to Initial Review on the same day. Its scared me and i immediately called USCIS to know whats happenning and have created an SR...so far no response yet. I have my approval notice, as you suggested i will take an INFO pass and get it stamped on my passport.
Please update your case in this thread.

I got my FP done on 10/05. My 485 status changed from Approved to Initial Review on that day. I believe it's auto status change. I have my approval notice and Permanent Resident stamp on my passport. I booked infopass appointment on 11/01 to know inquire about this change.

Update:
The Doctor admitted his mistake.
He completely forgot to mark the TB test earlier.
He was ready to back date to avoid more inconveniance to me.
But I told him to be sincere in all aspects.
I basically forced him to give my wife a TB test again and also the x-ray.
Now the plan is to submit all this information with a nice letter which states that the doctor had forgotten things last time etc etc.
Hopefully they will mark the case as - resume processing.
I also had some issues with my medical exam. Lesson learned is to have civil surgeon verify and double verify
the information entered in the exam.
