Hi, me and my wife we both r on H1b. My wife works with a solution & service LLC.say company A, now the owner is ready to start a new company, say B,with my wife as partner. She will be just passive investor in the company and getting profits, if any from company B. Can she still work full time with company A?. How can we invest in company B and take profits. What r IRS forms?. Finally any good attorney suggestions for Houston, TX.
What are the options for business formation,
Does anyone see any issue with this kind of formation and GC process for me.
Thanks,

First it wasn't 1000, we had over 2000 people registered and many joined after or did not register. So please don't say 1000, it is extremely painful for everyone who attended to be considered as "not counted".
1. Politically having a rally in D.C makes it more visible for all the law makers there. Laws/amendments and all the political activity happens there. Rallies else where would make it to one or two news cycle but won't be remembered after wards.
2. Meeting lawmakers, staff from various constituents wrapped around an event like a rally helps a lot in getting the message across. It raises a lot of awareness.
3. I would have agreed with you that numbers like 100,000 matters, but after being there and seeing the amazing capabilities of IV to organize meetings and having members meet over 100+ meetings with law makers, staff, talking to to them, sharing personal stories, advertisement and media campaigns around D.C has convinced me that it has and will make a difference! Personally for me, it was an eye opener on how the system works and I totally understood exactly why IV leaders set it up this way just by being around and them for a few days!

Agreed - but as far as the larger public is concerned......if washington post, a local dc mainstream newspaper, says it was 1,000 - the number in public mind is 1,000 (though 10,000 might have participated.....and when lawmakers set their priorities - all they are concerned about is ........
ok - 1,000 folks (none of them voters) are asking me for a comprehensive employment based GC reform......which is a pain in the .......!!
2,000 excited parents (85% of them registered voters) are asking for a new ice skating rink at a local school or residents of a neighborhood (again 65% voters, accounting for immigrants among residents) want a new station on commuter rail line or a new bus route or whatever......all of them easy to achieve.......
and the lawmaker wonders over a cup of decaf latte - what should i focus on......??? to him/ her - the choice is obvious.....and if it is not obvious to us........we should take a reality check.....
It would be a different thing - if 100,000 people do a silent lunch time gathering within the campuses of a revered american company like Cisco or Msoft.......with organizational blessings......people would sit up and listen.....
Personally, I did not attend the DC event because I was travelling on business and to me my perceived benefit (maybe wrong) of rally was not worth postponing an important business trip.......on the other hand if one day it so transpires that this rally was the historic starting point of major immigration reforms triggered by a group of pioneering individuals - i would have no choice but to eat my words and hang my head in shame that i did not attend.............

All the way one keeps thinking that you are free to start a business, look for more exciting opportunities, go work in starbacuks...( yeah all that )...once you get a GC..
But, now everyone is talking about again sticking to the sponsoring employer, a green card being revoked while entry...and umpteen scenarios...
So, where does it end..when can one really feel you can flex yourself and do something without worrying about my employment history...

Barack Obama pledges to fix the broken immigration system - US - World - The Times of India (http://timesofindia.indiatimes.com/world/us/Barack-Obama-pledges-to-fix-the-broken-immigration-system/articleshow/6116661.cms)
WASHINGTON: US President Barack Obama on Thursday pledged to fix the "broken" immigration system of America to make it easier for the best and the brightest of the people to enter the country, that has nearly 11 million illegal immigrants.
In his first major policy speech on immigration, Obama revealed the broad contours of his vision of reform, which if implemented would be helpful to hundreds and thousands of people from countries like India, who are professionals and law abiding and add value to the American society.
"We should make it easier for the best and the brightest to come to start businesses and develop products and create jobs. Our laws should respect families following the rules, instead of splitting them apart," Obama said.
"We need to provide farms a legal way to hire the workers they rely on, and a path for those workers to earn legal status," he said.
The president said the system should stop penalising innocent young people for the actions of their parents, by denying them the chance to stay and contribute to build the country.
He said the presence of about 11 million illegal immigrants makes a mockery of all those who are going through the process of immigrating legally.
"Indeed, after years of patchwork fixes and ill-conceived revisions, the legal immigration system is as broken as the borders. Backlogs and bureaucracy means the process can take years," he observed.
He was quick to add that immigration reform has been held hostage to political posturing and special interest wrangling and to the pervasive sentiment in Washington that tackling such a thorny and emotional issue is inherently bad politics.
The president said besides addressing the issue of illegal immigrants, a reformed system also needs to address the need for talented people to stay and contribute to the country.
"While an applicant waits for approval, he or she is often forbidden from visiting the US, which means even husbands and wives may be forced to spend many years apart... High fees and need for lawyers may exclude worthy applicants.
"While we provide students from around the world visas to get engineering and computer science degrees at our top universities, our laws discourage them from using those skills to start a business or power a new industry right here in the United States," Obama said.
He said instead of training entrepreneurs to create jobs, "we train our competition", adding: "In sum, the system is broken, and everybody knows it".

I also have a 3 year Bachelor's degree (BSc Physics) + 3 Year masters degree (MCA) from India. I would like to get it evaluated. Could you please let me know which education evaluation agency you used?
Is you bachelor and master degree in the same or related discipline? I read somewhere that the bachelors and master's will have to be in the same or related fields for it to be considered equivalent to US Masters degree.
I haven't seen one 140 get denied due to a 3 +3 education. Any evaluation agency will give masters equivalent. You can use any one of them.

Nola,
Thanks for clarifying. IV appreciates support from LGBT community. You have done amazing amount of work for IV in the recent past. Some of the Bay area folks still remember your leadership at 5K run at San Francisco Golden Gate. You created a decent amount of buzz by bringing along your friends all the way to California.
IV members: Having said that, I would just like to remind some IV members to be mindful of the fact that we enjoy support from diverse groups of people and it makes sense to extend reciprocal courtesy when responding to some of the posts here e.g. the UAFA bill etc.
Cheers!
g
Weldonsprings, you might be mistaken about the UAFA bill which is up for a vote on June 3, 2009. The intent of the UAFA is to allow US Citizens and permanent residents to sponsor their foreign-born partners for permanent residency by means of demonstrating a "permanent partnership". Let me re-emphasize, this bill is geared primarily for the LGBT Community of which I am a proud member, so if you are supporting this bill, my thanks to you.
[QUOTE=WeldonSprings;343823]That is correct! The bills in the house and senate coming up for discussion does not mention visa re-capture. However, Please look at the titles-don't they sound the same. The contents are different. The content of S.424 is to give permanent residents the same STATUS as US citizens so that they can sponsor their wives, parents, brothers, sisters and doggies...So an amendment is necessary. That's why I have written in the original post-

1. The company is not mean to revoke my 140 unless it is required by law to revoke 140 for all lay offs, Please advise.
2. What options do i have now to retain my GC process

Out of curiosity, what are your thoughts on ROW EB3?
I wouldn't expect any movement for EB3 ROW. I'd be happy if it doesn't retrogress further or turn out to be "U". I Base my assumption on the horizontal spillover from EB2 ROW to the rest of EB2 categories. If there is any movement for EB3 ROW i would guess it would come sometime in the 4th quarter.

OK my conclusion:nature exists but not GOD.
For you
it's nature = GOD
I mean
nature = Rama/Krishna etc..(If you are a Hindu)
nature = Jesus(If you are a christian)
nature = Allah(If you are a Muslim)
.
.
.
Both are Same ( Just a different term).
What ever makes you happy believe that.
Some People believes in term "God" and Some believe in term "Nature"
World is big enough So that both "nature" and "god" words can co-exists.

If you are in the United States and seek advance parole:
A. You may apply if you have an adjustment- of- status application pending and you seek to travel abroad for emergent personal or bona fide business reasons;
we can come up with many excuses that would easily fall under "emergent personal or bona fide business reasons" category.
I thought we must get ready with some reasons, when using AP to re-enter US. I have come up with some of my own that I may use:
1) Grandpa or Grandma is sick (most common reason, perhaps no body uses it as a reason anymore)(bona fide personal reason)
2) Land dispute (bona fide business reason)
3) Parents home need urgent repair (bona fide business reason)
4) Water shortage problem (bona fide business reason)

WASHINGTON, D.C. U.S. Senators Bill Frist (R-Tenn.), Chuck Hagel (R-Neb.), Mel Martinez (R-Fla.), Jon Kyl (R-Ariz.), John McCain (R-Ariz.), Lindsey Graham (R-S.C.) and John Cornyn (R-Texas) today released the following joint statement regarding the unanimous consent agreement to bring comprehensive immigration reform legislation back to the Senate floor Monday:
Under the unanimous consent agreement reached today, the Senate will resume the immigration debate next week. Senate Republicans are united in their commitment to an open and full debate on multiple amendments -- just as we have done on other bills of this magnitude like bankruptcy and class action reform. We are willing to put differences aside so we can get on with the important work to be done securing our borders and grappling with the 12 million illegal immigrants currently living in our country. We are also in agreement that efforts to curtail the debate prematurely will only derail this process. We call on Senate Democrats to allow an open debate and votes on this complex and challenging issue.

Thanks hpandey and apume. Your suggestions are very helpful. I will definitely take FMLA and take the leave for 3 months. Once the baby is born, I will try to get into new job ASAP.
I don't want anyone to be discriminated like me in the future. I know how painful it is as I am facing it now. I am hardly getting sleep and worried about my baby becoz of all the stress.
