My wife changed her job after getting H1B transfer receipt. Her previous H1B is not expired or revoked. After one month with new employer, her H1B is denied. We didn't appeal, but immediately filed new H1B with another employer and give paystub of the denied employer with all details. She got her H1B approved with the latest employer. This happened 4 years back.
So, if H1B denied, you can file appeal or find a new job and file new petition ASAP.

Before Sep 2009 it was two minutes time to take LCA. Now it takes 1 week time to approve LCA. We never heard about Employer-Employee relationship before 2010.

Same happened to us. The checks were cashed and we have even received the appointment notices for biometrics. My lawyer told me that there have been several cases lake this one. He is going to submit proof of the checks being cashed and copy of the notices to the USCIS.

Yes, the rule is to carry the original. If lost, apply for a new one. So, i preached.
I never carry it, one day one immigration officer is going to catch me and grill me.

You need to follow instructions. It makes no difference in processing time if your I-485 application is pending in NSC and based on instruction you need to apply in TSC and Vice Versa.
In fact I think, load sharing is going on. I applied I-765 at NSC but case is handled by MSC. Don't be surprized, that you apply at TSC and case being handled by other office.

Krishna_brc is correct. H1 B alien can be on medical leave, sick leave and can be unpaid during that period.
Get a letter from your employer saying they are granting you a personal unpaid vacation as per your request(which can be done using a pre-dated letter to them). Make sure you are getting your medical coverage from them(if you have it through them). Provide that and an explanation that you are taking personal time off due to health etc/stress. Hopefully that is flies with the USCIS.
Per law you are can get vacation for which the company has to pay you or you can also avail of unpaid vacation.

I just want to know why people think like that. Whoever I talk to thinks that after getting EAD everything is good and greencard is not that important. Is that true.

It takes one week to get the visa stamped. I did it and went to India in August. They will schedule FP for you in a location close to you.
Shame on you....travel thru countries that don't steal your money in the form of 'transit visa'.

Im trying frantically to post this as a new thread but in vain . I would be ogliged if any1 of u can guide me through the process . Also not wasting further time i would like some info which is purely based on my discretion , but suggestion is well appreciated from u end .I would like to know wat r the things to be followed in h1 . Currently im facing issue with my h1 ie , my h1 was approved from this year lottery and it had a query which i have sent a letter to ins through my consultant , in aug but i have not recd any update so far . Im all confused as to what is my status coz at time im told that im on student visa and at time on h1 . Also if i find a job i will be paid only wen its valid . currently i stand on a crossroad of confusion , agony , pain and frustation . pls some 1 guide me thrgh this and if reqd i would apprecciate if u can also mail me . I understand that your intention is to get heard. I appreciate your effort at writing letter. However writing to the president will not help us much. Here is why:
In the USA, infact for that matter in most democracies, Laws are made by elected representatives unless it is an executive order to grant an immediate relief.
The composition and powers of the House and the Senate are established in Article One of the Constitution. The major power of the House is to pass federal legislation that affects the entire country, although its bills must also be passed by the Senate and further agreed to by the President before becoming law (unless both the House and Senate re-pass the legislation with a two-thirds majority in each chamber). The total number of voting representatives is fixed by law at no more than 435.[1] (United States congressional apportionment - Wikipedia, the free encyclopedia (http://en.wikipedia.org/wiki/United_States_congressional_apportionment))
So, In our case, the president at the most can sympathise with our cause and the hardships we face because of the limbo, But he cannot really help until there is a bill that passes both the house and the senate.
So, Can I suggest that it will be even more worthwhile if you contact your congressman/woman and go meet them. We need them to understand our plight and anguish.
We all need to go meet our lawmakers, educate them.

It really comes down to how long you can wait in US (You didn't say by when u need to go to canada) and how long you are willing to wait for GC living in canada.
I personally would like to move on with my life if I move to canada. (I have waited so many years for GC.)
Given your PD of Aug 2001, I think you would be able to file 485 within a year or so. If you can stay in US for another year you may not have to think about this.
Not sure of schools since I dont have any kids of school going age yet. However dont expect that much disp[arity in educational standards from Toronto.
Yes employment opp from spouse may be limited. However there is atleast a chance compared to staying in the US. Windsor real estate is also much cheaper than Toronto (you can buy a decent home in Windsor for 200 K. You will need 300 K in Toronto for same house).
Plus if you come to the point there is no way your GC will ever come, you can always move from Windsor to Toronto.

Because of illegals granted amnesty any legal immigrant filing after Apil 30, 2001 faced longer waits and backlogs because they consumed the existing quota of immigrant visas. In essencem legals were penalized for obeying the law and standing in line.
Let's do a poll to see how many EB3IND folks will be willing to be a party to a class action lawsuit to provide relief. Obviosuly if the lawsuit prevails the plaintiff's pending GC applications will be approved. GCOP, mirage or anyone else- want to put up a poll (i don't know how to do it)
This might be a better option for many who cannot do a Writ of Mandamus lawsuit

I have created several documents and am working on a similar one as outlined below. But we need 50 people working on such items instead of one.
We have lots of ideas pouring into threads here but most are soon forgotten and not followed up on.
gc_peshwa has created a googlegroup to deal with participating on USCIS calls etc. We can add this agenda to that group to prevent creation of too many googlegroups and spreading ourselves thin. Alternatively we have a "Media" googlegroup as well which is dormant. That group could be used for this purpose.
