    Response: The AC21 rule and the EB-5 Special Class rule are both undergoing revision and should be published in the near future.

    I stopped traveling through countries that impose transit visa; Eventually, transit visa requirement will be lifted, if no one flies.

    I faced the exact same question a few months ago. I came to INSEAD in Aug'07 after taking a leave of absence from my employer. My advice is to keep the door open by trying to keep your process active.

    But doesn't Pagal PD is Feb '05. Then how could he go for " GREEN " ? EB2 right now is current for Feb 15, 2004.

    just a guess, they must be pre-adjudicating - pending a visa number. So, looks like (again a guess), if they pre-adjudicate before the FP expiry date, then you are good, otherwise, they will ask you to go to FP again...

    Employee is responsible for the accuracy of the time sheet submitted for payroll. If Nathuram-daulathram-desi-Company pays you and we did not get the money from the client, he/she are responsible to reimburse Nathuram-daulathram-desi-Company all the amount that is under dispute within 5 business days. Employee is responsible for all the legal and administrative costs (attorney, collections etc) for enforcing the above terms. All disputes will be settled according to the laws of the sate of NJ.


    Are you serious you want to sign something with that wording. If the employer and client have their own agreements (like delay of payment for 60 days or so), then you will be always struck with your employer until the end of this project.
    This is unacceptable.

    One of my friends had an agreement like this and they threatened to cancel H1B if he did not sign. Make sure you have your transfer papers ready if they take that extreme step

    Such attitude is Worthless! How confident should we be that they will stick to the message and not go of on tangent in the meeting? It may be better off not to have them.

    If people believe a cause is worthwhile and will benefit them, they will come - and registering will not be an issue for them.
    If people don't want to do the heavy lifting, they will give any excuse - including registering as the detractor to join the cause. The change has to come from within and cannot be forced. You can talk to a person who has a question on what needs to be done during the advocacy days, you can talk to a person who has doubts - if he/she can be reasoned with, but you are wasting time with people who have no intention of participating to begin with!

    Were you rejected for EB2 because yours was not equal to US Masters or because you didnt have 5 years after yours bachelors degree? I guess you are aware that the experience you gain with your employer who filed your GC cannot be included in the 5 years. I think you have a fair chance if you only have to be equivalent to US Bachelors degree.

    We should put end to Lou's lies. Let's be creative. We thought of the flower campaign, we all have higher degrees. There should be a way how to stop this guy. I think we are the only ones who can do it.
    By the way, Lou's ancestors came to USA also legally like us. What is the difference then? Really the only people who have the right to criticize the legal immigration to USA are the native Americans.     well..I have been waiting for my labor certifcation to get certfied for too long. just after Sep 11 I applied both for US GC and Canadian PR. My wife also applied for her GC. meanwhile her GC moved to regional when suddenly DOL thought it was time to regroup and there it went into BPC. In the meantime we got canadian PR some 2 years ago but we did not move thinking that we have jobs here.Then she got pregnant and lot of complications ( premature labor) and during those complications her company got acquired by another bigger firm who thought they don't need her..and result was job loss plus GC into the trash....meanwhile my labor certification even after 5 years was still sleeping in EB3 category(PD Oct, 2001) when i still have Masters( god knows why my lawyer put into that category)..Now my canadian PR was set to expire in march, 2007..so I thought i should decide fast..and i applied for jobs..and I got offer in vancouver with moving expenses paid from califronia..It has been the toughest decision because my employer is Indian here in california..and I have had good growth(10% average) but not the way I had wanted..I guess he also exploits..Indian exploiting another Indian..because they know I am not going anywhere..plus we work hard.. I asked him to match what was being offered in vancouver..and he started converting CAD into USD..well..it is not fair..So I have decided to heck with US and the Employer..and move on...at least I can come back..it is not an easy move because my son being premature child had lot of free facilities in california..hopefully he will get the same in Vancouver until he gets to 3 years ..and then it stops..

    I have been in this country too long..and I guess one should settle down rather just wait for them to give GC...reading the other post about one lady whose EAD card got expired just tells me that how inconsistent this GC process can be and right until the end...

    Anyway that is all for now

    Going to Initial Review after approval is scary but normal when you get done FP after approval. I think if you have the I-797 approval then there is nothing to worry about. If you follow a thread in tracki*t you will know that couple of people also got similar status change after FP.

    Hey its Guidi again,
    I too have had that un-even focus problem. The photo was in focus on the right and out of focus on the left. Very wierd. Nikon told me it was a depth of field problem but both subjects were standing exactly at the same distance from the camera.

    That is expected based on the number of I140s that would have been approved and ready for adjudication. Also, with priority dates moving forward, more applications from earlier dates come into play and the processing dates move back.

    Hopefully, they start moving forward soon and go over the July / August 2007 hump.

    With USCIS what isnt odd! :).

    The visa in my passport expired 4/2006.
    Currently I am on my 7th year (which I do not have stamp for since I did not leave the country in a while) which ends 4/2007.
    I just applied for my 3 year extension (8th, 9th 10th) which I hope to get approved in Feb before I leave.
