As per AC21 rule, it is from Receipt. However, let's put some practicality into the matter. Some IO's interpret the rule wrongly and used Notice Date instead. So what will happen? Your GC denied for wrong reasons and you file for MTR because it was USCIS mistake. If you're willing to take the chance, then go. If not, better use Notice Date for practicality purposes and to avoid all the hassle of MTR, etc.

I am seeing layoffs are on rise in IT sector these days in California. I am in a good business district area in southern California and most of the companies have frozen new hirings and lots of others are laying off.
Job sites are showing many openings but even if you apply the percentage of calls you get have reduced drastically. Hanging on to wht you got if you can seems to be the only option these days..

Hi,
I am currently on H1B and my 6 years is ending later this year. I have a Canadian PR and planning to move to Canada permanently before my H1 visa ends.
As I will be exporting my car I am planning to leave US by "Land"- mostly via Blaine,WA - Peace Arch border to enter BC, Canada.
The question I have is : where to return my I-94 (expired and the extended one that came with I797) when I leave by LAND as there are no "US CBP agents/office" when we leave US by land. I went through US CBP website and find that there is a process to send I-94 after leaving the country to "ACS - CBP SBU , KY".
Unfortunately as I will be entering as a Canadian PR, there will not be any stamp in my passport to record my entry to Canada and hence won't be able to prove to "ACS - CBP SBU , KY" my date of departure from US. The reason I am worried is that I don't want to get in to any overstay issues if I need to come to US in future.
Any thoughts/suggestions on how I can overcome this issue and record my departure correctly when leaving US via LAND?

My wife worked as a consultant for first half of 2008 with a desi employer as an employee (on W-2). After many calls and emails we received W-2 Thursday that has income and taxes of only first two months. Now he says that he showed remaining 4 months as his profit so he can only send 1099. Please advise if I can take any legal action against this employer.

least $20,000 per visa, the US Attorney's Office said.
Mahendrakumar "Mack" Patel, 55, Rakesh Patel, 36, Alberto Pena, 38, Bernardo Pena, 38, and Marte Othon Villar Sr, 48, encouraged and induced the illegal immigration of Indian nationals in exchange for tens of thousands of dollars per visa, a statement from the US Attorney's Office said yesterday.
The jury found that Alberto and Bernardo Pena, twin brothers from Brownsville, along with co-defendants had encouraged and induced 87 individuals from Gujarat to unlawfully enter US on temporary H-2B visas, knowing that the Indian nationals did not intend to work for the company that was used to get visas for them.
The brothers also knew that the visa-seekers did not intend to return to India when their 10-month visas expired, a statement said.
Pena twins also travelled to India to assist the Indian nationals with the application process and visited and corresponded with the US Consulate in Mumbai.
Two other co-defendants -- Mack Patel of Ft Worth and Rakesh Patel, a Houston pharmacist -- pleaded guilty for recruiting Indian citizens who were willing to pay $20,000 to $60,000 in exchange for visas to enter the United States

This is my opinion. TSC 485 processing time is July 17,2007. NSC 485 processing cut off date is July 28th, 2007. I don't know if CSC is still processing 485 EB applications but CSC EB processing cut off date on its website is April 04, 2006. The priority date for June 2007 bulletin was April 1st2004.
Lot of big law firms filed 485's around August 1st because the date for filing 485's was extended to August 17th. So I think these 485's are still unadjudicated. Once they get adjudicated there would be retrogression. Analysts analyze. However the silver lining would be removal of concurrent processing of I-140 and I-485 which may give some additional EB 2 numbers next year.

Abusive behaviour wont be tolerated here at all.
Let us be focussed on the much needed Action Items. We need participation from IV'ans and we need more volunteers. The people working on putting the Action Items together, ppl. meeting/calling the law makers,
ppl. working on fundraising are all the same people and unfortunately we only have 24 hours in a day just like everyone else.
Thanks to all the gurus in IV ...last week I was also being abused with these so called repos and i brought it into everyons notice....i'm so happy to see u guys taking step against them despite of ur busy schedule. thanks once again.

Thanks to all your inputs. It was really helpful.
I crossed the border - Blaine, WA to reenter Canada as PR. I went inside the US CBP office at the Border to complete my Car export process. I asked the CBP officer in charge for the export processing about returning my I-94. He took it from me and talked to the CBP officers managing the entry/exit procedures. Not sure what they talked as the line for export processing is far away from the regular line for immigration process. I saw the officer leaving the I-94 in one of the tables but nothing was entered in the system at that time. I asked the export officer if I need to do anything else and he said I am good to go.
I have no way of knowing if my exit from US was properly recorded. Hopefully, the US customs seal on my Car Title and other paper work I got from the Canadian side along with my residency (DL in BC) docs should help me to prove my stay outside US when I go for stamping next time/enter US POE. Keeping my fingers crossed till I enter US next time!

My understanding is that Sen Maj. Leader and Min leader pick senate
conferees. Similar with house. Democrats support the bill. Most of the
republicans oppose it. House and Senate Bill are different like day and
night. The bill has to pass because.
1. Enforcement and Boarder protection is highly needed and the house
really want it. If they need it they have to make some sacrifice accepting
guest workers program with slight modification etc. Otherway the CIR supporting conferees may not agree and bill dies leaving things same as now
which nobody wants.
2. Election is approaching. Most of the leaders in Rep party openly admitted
that Enforcement only bill will affect them adversly
3. Mr. Persident is a strongly supporting Guest Worker program.
4. If a enforcement only bill is pased thats going to affect the relationship
with Mexico.
I believe the House is against legal immigration too. Otherway some provisions might have survived in the budget bill. My biggest worry is that
if CIR supporters and Opposers (conferees) will be happy to remove legal immigration provisions in the in the reconcilation process and call it deal!

I got an email saying "we mailed the document to the applicant" and it says the same thing on my uscis protfolio.
I would like to know if this means the case was approved or is it some other document being sent.
When they approved my EAD, it clearly said "Approval notice sent".
When they approve a case then status clearly says 'Case Approved'.
The email "we mailed the document to the applicant" may be anything or nothing, like if they transfer ur case to different service centre, they send a notice. Some time they don't send anything even though the email contradicts it. Keep checking the status, they might update it later if the case has been approved.
Also, for AP keep bugging ur attorney to see if they got it. For EAD, make sure your mail box has your name clearly, otherwise they won't deliver it.

I am stuck in EB3 and want to apply for EB2. How does one find companies willing to do EB2? With desi consulting companies you can ask upfront to the recruiter but with american companies can you do the same?

Yes you can include your spouse to 485 when dates are current and is not dependent on H1B transfer.

I got my Wife's and son's passports renewed at NY. I printed the phtos on the computer. My wife's i mailed it(got it back in 1 week). My sons i went to NY. If you go before 11AM, you can collect it back same evening. I did this almost 18 months ago.
