We are working really hard to get our amendments in. Please understand, we are not doing this for fun. We are into this just like you for our green cards. It would really help if we get support instead of having to answer the same questions over and over

We are trying to get our amendments in the bill. It is not an easy task considering that the senators have achieved a fine balance behind the doors and are unwilling to be the ones to break it. But again, we are going full steam with this as it means as much to us as to you. And remember, we are a voluntary non-profit organization. i just read on another forum, that about 70,000 visa's come up for the new fiscal year which starts 1st october, so it might take a couple of months to see any movement, but it will happen, as they have got to wait and see and get a better feel for how many filers there were for july/augest, as they havent processed them all yet, then we will see something happen. so lets wait and see what the Nov bullitin says, and if the rally had any kind of effect.

This is my thought process (also referred by Ron G):
July 2007 brought in approximately 500K 485 cases.
We do not know how many cases were pending as of June 2007.
Fiscal year 2007-2008 USCIS used over 140K EB VISA numbers (I think it was around 155K).
Fiscal year 2008-2009 USCIS will use atleast 140K EB VISA numbers
so, 500K - 300K = 200K.
Assuming USICS approval rate is 85%; 75K of 500K are denied.
200K - 75K = 125K EB cases pending from the July 2007 cases.
Additions: from all current categories - may be 25 K in 2 years?
So, 150 K plus whatever that was pending as of June 2007.
So next fiscal year, 2009 if USCIS uses the quota 140 K, most or all of the 2007 filings will be cleared. If not EB3 I, definitely EB2 I and C, EB3 ROW will be cleared.
Depending on new filings, EB3 I might retrogress but retrogression might come within 3-4 years instead of current 8 years.
I strongly believe, beginning Jan 2010, dates for EB2 (I and C) will move forward heaps and bounds followed by EB3 ROW.

One potential loophole (I realize it could be wishful thinking on our part) is how the current law is interpreted. Let's say USCIS interprets the current law in such way that preadjudcated cases have to be approved before taking in new cases, then the country cap hurdle could be overcome without legislation.
With the current economic situation, tightening of PERM, etc new EB-2 row applications are likely to slow down further. At the most, new approvals will have to be delayed by 12 months or less.
Could it be legally challenged? Could someone bring a lawsuit to force USCIS to stop issuing GCs to people who have been waiting 10+ yrs or more? possible. I doubt anyone can force them to cancel the already issued GCs.
Then USCIS could say they have enough preadjudicated cases, and are not able to adjudicate until they clear the backlog.;)
For the politicians and USCIS this is a much better way to handle India EB backlog than to "issue several hudred thousands of foreign laborers immigrant visas when American citizens are losing jobs in millions" through recapture bill.
I feel like I just wrote a short story.:)

Looks like the guy we engage for our cause gets a shot to speak about immigration on WSJ and guess what he forgets us all together. Great job for picking QGA core team.

I don’t mean to insult your intelligence, but who ever came up with ideas to ask, celebrities, a noble laurite and other accomplished folks from the immigration community to send faxes does not have the slightest plan on how to make this succeed.
If this is the kind of ideas the “lobbyists” QGA is giving us, may we need some fresh blood in helping us out. I completely agree “eb3retro” in working with AILA.org in helping us get our message across. PLEASE STOP THIS INSANE IDEA OF SENDING FAXES all the time either from members of IV or asking other people to do it on our behalf. We are hurting ourselves and don’t even know it. As I have said in my earlier posts “We need the Erin Brockovich of immigration to help us on this, and I am the AILA or similar organization can do this for us.”

1) You have NO idea what it was like to find a lobbyist ready to work with us given a) We are dealing with a very sensitive issue b) We had only 10K in cash (5K raised by core members) and another 10K promised again by the core team. Do a real exercise and get a lobbyist to sign a contract with you for after revealing to them that you have only 20K. Try it now with even 50K and see how many lobbyists are ready to tow your line
2) Regarding your talk of Erin Brockovich and all, you do not even seem to grasp the fact that AILA is interested in the 11 million undocument workers. 500,000 skilled workers are nothing but a drop in the ocean compared to them.
In any case, have you done your part in contacting AILA? We have! Its easy to sit on the fence and complain but it takes conviction to actually DO something
3) Do you have any idea how difficult the task is to get amendments in? Do you know how much a fine balance the Republicans and Democrats achieved and are not ready to take on anything that might disturb the balance? Also do not forget that 500K people is not even 1% of the US population but 11 Million illegal immigrants make a sizeable chunk and alsong with Hispanics make more than 13% of the population. Sorry to hear this. Regarding medical insurance, your company has to offer you COBRA..you will end up paying almost twice the premium that you have been paying so far, but it would still be better than you footing the delivery charges (10k - 25K). Continue CORBA atleast till the deliver and post-partum - for as long as possible..
Terminating you in your ninth month pregnancy is probably against the law, i think if you can prove it, you might be able to sue your employer, check your local state laws..

My RD at NSC was 07/02/07 and my EAD status changed to "production ordered" just 5 days back(still dont know when I will get it). I think NSC is taking upto 5 months from RD to process the EADs.

Who ever go for testifying before congress should hightlight the USCIS mis use of VISA numbers during 2004 and 2005 by approving all latest cases and even though there are pending old cases
so that it will not redo the same in future incase dates move forward??

Does anyone know whether hard copy of Labor approval is required for filing Form 1-140. My Labor status shows certified, but my lawyer is conveying that they have not received my hard copy of approval to process Form I-140 and 485. Can some one tell me if we can take a print out of Labor approval from online status and use it for filing 140.

As I understand it correctly, you have a very personal reason for not getting married before Sept 07. I have to say that in that case, go ahead and at least file for your green card, that way you create one more option of applying through family based, even if it means 6-7 years of waiting period. Ideally you would like her to come to states at least for 2-3 business days to get court marriage and filing of docs, but if thats not the case then this is your best option.

Meeting at hindu center in flushing on Sun evenings would not work so well due to the prayers being held during Sun evenings at the temple. I think we should poll people on when it's most conveninent for them to meet and go from there...

Hello Guys,
I need your advice here. Six month ago i joined one of the many blood suckers -Desi cosulting company in new jersey. As you all know, they ask me to sign their contract in which its mention that if i leave their company before 1 year then i need to pay them 15k. Thy also charge me 3k for my H1-B which i am still paying everymonth from my paycheck and we have 70/30. In just six months i am so much fed up with them. These people are so rude...always show their arrogance over phone. I have no libarity to find job by myself. They always looking for higher pay rate sp that their big money tummy get filled up.and i also feel that they didnt told me the right pay rate for the project i am working on right now.
I really want to leave them, Even before 12 months. Is there any importance of that contract letter i signed with them?. Can they Sue me? What are my options? Please suggest me.....i am in stress.

Follow these steps.
I assume you have proof that you paid for H1B expenses.
Silently transfer your H1 to a new employer.( Your current employer won't even know that)
If they threaten you with the contract, tell them you will report them to DOL.
It is illegal for employer to ask money for H1B expenses.

in my humble opinion, we will never find justice and fairness here. UK has already moved in that direction as well. at the rate it is going, every year the GC queue gets longer by _seven_ years.

sadly, the main instrument in our exploitation have been other desis. people at work use my work to become CTOs. i get 500 buck a _year_ increase. when i complain they say "indians can't talk" so they can't rise. what crap. I've lived all over the world and no one ever said i could not talk. they just want to come up with ways to take credit of your work.

Since we cannot vote, and don't have enough money to lobby (bribe) the politicians, we're orphans here. here money talks, BS walks.
