Also, i received the EADs in mail, but haven't received the AP even though online status reads AP mailed a week back. Any idea how long it takes to get AP after it online status reads approved?

Hi ,
I received RFE on my I-131 application asking for all the I-94's that is being issued to me.
I had been in and out of US many times and there's lot if I-94's involved and I don't anything with me except the latest. What options do I have?... Also couple of times during my earlier trip (initial visits in US), the AIR Line didn't even take the I-94 from my Passport which ultimately I lost.
My Passport has all the entries indicating my Date in and Date out...
Gurus - What do you advise on my case...
Anybody's input are highly appreciated and I know we could somehow get the I-94 copies by requesting USCIS. (That is time consuming)... I have to respond in next five to ten days...
What options do I have?...

Congrats for the painless Visa stamping.
If you are on EAD before leaving US, you better to continue the same status. Their might be a situation for USCIS considering giving up your AOS, if you enter US on H1b while you were on EAD before leaving US.

Guys,
I took an info pass last week to check the status of my case. Specifically to check whether the interfile is success or not. IO at USCIS office mentioned that she cannot check whether my case is in EB2 or EB3. I am surprised to hear that. Gurus any has this kind of experience?
Also, She mentioned that my case is assigned to an Officer on August 13th. Do any one has any info how many days(on average), an Office will take to approve a case. Any info. is helpful to me and all.
Overall the Field Office people were polite.

The proposed bill to give green card to PhDS does not include all the PhDs. PhDs listed as STEM(Science engineering technology majors) are only eligible through this bill in current form. Graduates from pharmacy, medicine, veterinary medicine, animal science are not listed as STEM. I am sure there are many more majors not listed as STEM. I think we should write a letter to congressmen about this anomaly. And I encourage non STEM PhDs to represent their concern so that we can unite and represent our concerns to the congress men. immigrtion service department has listed the subject codes fall under STEM.
You have to browse through the following link to see code for your major. http://nces.ed.gov/pubs2002/cip2000/ciplist.asp.
once you know the code for your major you can go to http://www.ice.gov/sevis/stemlist.htm to check weather your program is listed there as STEM.

They did say that they only had "a handful" of visas left. This advance is not necessarily inconsistent with that earlier statement. In order to use up visas and avoid waste, the Visa Office has to manage the quota to make sure that there are enough applications AND ADJUDICATIONS to exhaust the quota. They have no control over the CIS, but they do have control over the overseas consular posts.
What this tells me is that the CIS is doing nothing (or next to nothing) to use up India and China E2 numbers. By advancing the cutoff dates last month, VO was able to make more cases at overseas posts available for close out. Since the CIS obviously did not use many China/India E2 numbers in July and August, VO has had to advance the cutoff dates again to make enough cases pending at consular posts available to use up those few remaining numbers.

My employer applied in PP and it was approved. details are give below.
Date of mailing -1/23( i presume must have used Fedex overnight)
Date of recipt/acknowledgement- 1/24
Date of approval- 2/4( online)
Date of approval email sent - 2/4
The only hitch was that they applied for 3 years extension based on 140 approval and even thougt 485 is filed the PD is not current,but got approval for 1 year only . The problem here i think is that i am completing 5 years oh H1B in feb 2008 so they extended only for 1 year till feb 2009 . Anyway that what you get when u ask your HR to file rather than have an attorney file ot handle the case. I had requested them to have an attorney handle the case but they gave me assurances that they will handle it and will do it in PP. Now i am sure they are repenting as i dont expect my GC approval for next 2 ot 3 years and now they got to shell out 1500 buck for extension every year or atleast for the next year when they retry for a 3 year extension in feb 2009.i had a word with my HR she said she is going to inquire with USCIS and discuss the case with attorney on what ground they offered one year extension and not 3 year

You already applied with approved LCA. Any amendment to LCA AFTER the RFE may not be looked upon kindly.. check that with lawyer..
What he means to say is, if you are saying your next 3 yrs project is in CA, then your LCA work location should not be in NC.
If your LCA work location is in NC then they have asked for NC based contract.. I would provide that, and not one in CA. your case needs more detailed look before you dump everything in USCIS lap..

Last jan one of my friends who runs his own firm , applied for 6 H1bs of these 5 got RFEs similar to these.. he replied to each one with 300+ page reply , they approved all within 4 days.. so it's impossible for anyone to read thro' they basically do it for 2 reasons..

Other than that, smaller stuff .. don't sweat.. Just don't go making changes to LCA or anything like that in panic..

The benefits to the porting are obvious. However let me share with you the considerations:
1) You have to change jobs presumably on another H1b visa in order to do so. There is inherently a risk in this when you do not have a green card. You'd certainly be a brave soul to change jobs on an EAD based on your EB3 petition while trying for an EB2 petition. How would you justify the same/similar requirement?
2) PERM labor certification is not going to be what it was previously given the current oversight.
3) Ported cases will definitely get more scrutiny (and probably more RFEs) from the USCIS.
4) Premium processing of 140 petitions is for a narrow subset of 140 filers who need to extend their H1b visas, failing which you are likely to take well over a year to get you 140 approved and therefore your PD ported.
5) Political calculations and the elections will be over by later this year, there will definitely be the impetus to address immigration as an urgent issue in the new political cycle and there will likely be a solution. If you are at the 485 stage, with a retrogressed PD as your only issue then you have one problem, if you are at an earlier stage then you may not be approvable at the stage when they are "generous".
If even after all this you feel your best chances are with EB2 then you should go ahead.

I am not sure how effective these new laws are. I recently renewed my Texas DL after expiry...I renewed it online...expecting for them to ask me for visa documents...instead I got the new DL in mail a few days later.
Maybe the databases are connected somehow & they verified my immigration details....but I very much doubt it. Sometimes you wonder why its so easy to be an illegal immigrant in the US.
However I did notice (in a city nearby in the same state - not the one I live in) that when you go in person, they ask for visa details.

I think its more than 3 since I got a notice about my 2003 state taxes in 2007 which they said they never received and I got stuck with a penalty ( although I was getting a refund ). I paid the penalty since it would have been too much of a hassle to go through 2003 records and then duelling it out with the IRS.

Instead of asking for more bread, we are fighting ferociously for the scraps like dogs!
It was estimated by Compete America that if the last CIR had passed there would have been more than 500,000 visa numbers recaptured ( don't ask me for the math, I didn't come up with this number). Assuming that the Nurses took away a chunk of it, we still would have a big chunk to statify Eb3, Eb3, ROW, India, China etc. etc. And the nurses are going to walk away with a big chunk folks - whether we like it or not - because we are fighting each other like dogs for the scraps of the spillover, while they will come up well organized and walk away with the cake.
Our disunity, lack of long-term vision, lack of action is our biggest weakness. We will not win unless we fight this together.
I agree with you my friend, lets see if this guy really shows up for the rally in Dc.
All those who wants to divide EB2 and EB3, can wait for their part of bread crumbs. I want the whole slice of bread, for which I believe a recapture visa bill is necessary.
I am coming to DC rally and for the Lobby. Are you? Are you going to sit home, watch TV news or will you be the part of making that news?

i'm not campaigning for obama...... simply trying to set the record straight.....
the title of this thread implies that obama is not doing admin fix.... its not always about the campaign & votes, sometimes its about the truth and the truth is that republicans leaked the draft admin memo and wrote letters to oppose admin fix.... but now everyone here is blaming obama..... i'm simply defending the absent.....
most people pass judgments based on incomplete or incorrect headlines...... i'm merely saying that there is more to the news than just the headlines.... & this is related to immigration.... unless u think that the only valid immigration question is - when will i get my gc......
it's a fact that he favors unions more. If tomorrow unions say no to hispanics he would kick most out...
