Just a quick update
Today my checks got cashed and from the back of the checks I got the receipt numbers. I was able to track these numbers on USCIS site and the EAD application for myself and my wife is now pending at TSC.
So the mailing address to Mesquite, TX turned out to be the correct location for me to file...
So it took less than a week for them to receive the package and cash your checks! I sent out mine to NSC today. Lets see how long it takes.

Hi Macaca:
USCIS cannot reject PERM as USCIS has nothing to do with PERM. PERM is done by the dept of labor, and this agency is not part of USCIS.
In terms of PERM, PERM is not considered an "immigrant petition" and thus would not be deemed as violation of status. PERM is berely the assurance there is no workers who want to take the job in the position beeing sought. Note, that when you go for a visa, one of the questions asked is, Have you ever filed an immigrant visa petions, or has an immigrant visa petiion was ever filed on your behalf?"
The law finds an immigrant petion only when one applies via I130 (family based immigrant petition" or I140 (employment based immigrant petition). Only filing of IMMIGRANT PETITION would constituate a violation of one's non-immigrant intent and status.
I went for consular approval last year. At that time I had applied for LC. The form had the question Have you ever filed an immigrant visa petion, or has an immigrant visa petiion was ever filed on your behalf? My attorney told me to say No.
USCIS has F1 file. Why did they not reject I-140?

My plan is making the following
Movie - A full length feature with characters that represent our life (includes H1 to GC process) in US with humor
Documentary - A professional documentary on our issues like H1 quota problems, GC backlog processing etc.
Any other thoughts from your side would help.
I am an ex NYFA student in digital film making. I would like to make the above two things by end of this year. Any of you are interested can participate. Again I don't need any money contributions. Just need your participation as actors, script writers and as other team members.
There is nothing funny about our state in US. Unless the humor is very dark the relevance will be lost. The idea can't bee to make another Monsoon Wedding.

If the other guy worked for the company atleast 180 days, then your employer cannot prove that he had no intention to work for the company. If the guy worked for only a short time or didn't work at all for the company, then the company can win the case.
The greencard of the other person will be rescinded. You can then use his labor.
We dont know all the details of the case. If the person who got 485 approved worked for more than 180 days for the sponsering employer.

I guess when it comes to GC processing, NOTHING is really "wrong" is it? If you get a chance to work around and beat the long lines, I guess "It's all good". Some people are lucky that they get a chance to get Labor Sub, some ppl marry the GC and some ppl like the rest of us wait in line like "honest citizens".
The REAL question is, just how many of us would have refused a good labour sub, given the present conditions, solely on the basis that "it is unfair to others"? I know i would have taken it. Reason? It's LEGAL (or used to be). Our "misfortune" (if i can use that word), is that we did not get a similar chance.
For those wondering, what I am babbling about: "Let's not look down on this guy who got his GC approved by Labour Sub, or even continuously point out that he did."

WANTED TO DRAW EVERYONE'S ATTENTION TO THIS
WASHINGTON Senate Majority Leader Harry Reid will approve a new deal on immigration on Thursday and move to bring the once-dead legislation back to the Senate floor next week, Democratic sources told FOX News.
Details of the immigration compromise remain to be finalized, but top Democratic sources say Reid has closely monitored the behind-the-scenes dickering over policy changes and a finite list of amendments due for consideration. Based on the latest updates on the policy and amendments, Reid will approve the compromise and move late Thursday to put the bill back on the calendar for Senate consideration in the middle of next week.
"He's going to bless it and he's going to get the Senate back in the business of dealing with immigration," said a source in the Democratic Senate leadership.
The principal change to the bipartisan immigration compromise that Reid shelved last week is the addition of $4.4 billion in added border security spending. That money will be added to the base bill to return to the floor. Any other changes to the immigration bill will have to be made through the amendment process.
The base immigration bill seeks to tighten border security, put an estimated 12 million illegal immigrants on a path to permanent residency and create a temporary worker program.
Republican leaders have promised to produce enough votes to curtail debate on the bill and proceed to final passage. Last week's impasse arose after Reid twice failed to collect the 60 votes necessary to limit debate and move toward final passage.
With the GOP votes in hand and a finite list of amendments to be offered by 11 Democratic and 11 Republican senators, Democratic sources said Reid is now determined to see whether the legislation can survive the amendment process intact. If it does, the Senate could vote on final passage of the bill by next Friday, Democratic sources said.
GOP sources tell FOX News that the new bill has enough support from Republicans for Reid to prevail on a procedural vote to get the bill to final passage.
Earlier in the day, President Bush agreed to the plan in hopes of winning over fellow Republicans.
"We're going to show the American people that the promises in this bill will be kept," Bush said in a speech to the Associated Builders and Contractors.
An earlier procedural vote on June 7 failed to get the 60 votes necessary to curtail debate, a defeat Reid said forced him to pull the bill.
That maneuver drastically diminished prospects for comprehensive immigration reform, but a tenacious lobbying effort by top Bush administration officials and the bipartisan architects of the so-called "grand compromise" have kept the bill on life support.
Many hurdles to passing the Senate bill remain. Still, efforts to revive the bill appear to have more momentum than at any time since Reid pulled the bill from the floor. All sides agree if a commitment to passing the bill isn't agreed to this week, the bill is likely to die.
FOX News' Major Garrett and Trish Turner contributed to this report.

It's all about money my friends. Legal are already paying taxes. What they want is all these 12 million people to pay taxes too. Once these ppl come forward and apply for legal visa they will be backloged and will keep paying fees and taxes. After 20 years another cycle.
Nothing is going to happen for legal. All efforts r waste.

This is about illegals. Do not fall for that trap.
These organizations are looking for bodies to send faxes. Illegals do not know computer and English. But programmers who sit in a cubicle all day and have plenty of time to go on websites and post, are a perfect fit to further the agenda of this organization.
Just ask yourself:
Has this organization leader spoken to you or IV asking for support and promised that they will work for legals?
So why are you promoting them?
They will not do anything for you if CIR comes.
Ganguteli, I hope you are not just a 'body'. Has anyone on this thread faxed anything through that website supporting illegals?? People @ IV (may be not all) are smart enough to use their tool for our advantage.

You are correct but I think I am not sure if one can change employer (H1B Transfer) during that 3 Year extended H1B period after 485 denial.
Total BS and Incorrect.
One can work on current H-1B (irrespective on basis it was approved), until the H-1B petition is revoked or canceled or expired. However, beneficiary is not eligible for new/extension of H-1B after I-485 denial.

:)), oh well, Indian government spent money on our education and we left India we may never won't back to India,
why the hell he cares for our issues
he will be glad to know that we can't stay here, becausre there is huge demand in India for most of our skill set.
we are like Dhobi Ka Kutha Na Gar ka Na Ghat Ka,
I don't agree with 'eb3india'. Don't be on negative attitudes. Negative thinking will not gain anything. Think positive !
India Government will listen to us because;
1) If you stay here in USA, you will send money to your parents and relatives.
They will spend money and improve indian economy.
2) If you stay here and become rich, you may start a busness in india and employ indians and indian economy will grow.
3) You may invest in houses and properties in india.
So, If you continue to work in US and make money, Indian economy will grow
indirectly. Did you get my point ? Mr Vayalar Ravi knows this very well. He knows the earning potential on NRIs in US.

like the historic successful flower campaign, can some one come out with a great idea to bring CIS attention to this issue? 'Satyagrah'??? Gandhi style fasting??? ideas?
USCIS is already aware of this. They have been notified through AILA and our letters are also working. IV has also been pushing for more broader AC21 regulations for a few months now.
Our request from IV is to keep sending the letters. Please send letters in thousands - not like 50 to 60 letters.
Everyone must take initiative and push other members. It is a very importasnt campaign.
It is very much possible that a lot of you may be a victim of AC21 denials. It is your call.
Please take responsibility and everyone must come forward and bring others also into this campaign.

You've ever heard of kamikaze missions help by Japanese pilots during world war 2?
They were suicide missions to bomb American targets (like Pearl Harbor) knowing very well they will not come back alive. They would crash their planes into enemy targets laden with a lot of explosives.
Go figure!
Whatever side you are on, there is no way you can liken kamikaze mission to a suicide. Kamikaze mission was of bravery, people willing to die for their countries -- that is the ultimate sacrifice. People committing suicide are just cowards who aren't strong enough to face life problems thrown at them. I am sure a lot of us here have lost investments too, but we are going to pick ourselves up and continue to make our lives -- not end it.

IV is not an Indian organization. If this is one of the reasons why few non-indian members are not making donations then please re-consider your decision and start donating.
Also let us not dillute our fight by expanding the fight to include other problems. Once we achieve desired results, we can continue to pick up other problems and lead the fight.
--sri
What part of my post indicated that I had not donated?! I was responding to claims that other nationalities affected have not stepped up and offered their time to help, in response to some one else's claim in this thread. I also suggested that the media tends to report what it wants to and this is not necessarily the full truth.
As a side note, you try pursuading people to join up here that don't fit into the demographic most vocal on this forum (i.e. anyone that is not Indian)... Which, incidently, is the group that I know and interact with (i.e. greencard applicants that are not Indian), and try and pursuade them that this group represents them too, when half of the posts say (paraphrasing) "well, its only the indian and chinese group that faces problems". I can guarantee you that this is extremely tricky when you ask people to see beyond the bias on a forum and pony up their cash.
It is this very reason, that when I see a thread that could be read negatively by this demographic, I do my best to remind people to be sensitive of this fact. How would you feel if you were being begged to contribute money, and then told that this issue doesn't affect you (which has happened to me)? Every single person on this forum needs to realize that, and I'm NOT talking about the core team, they do a fantastic job and acknowledge every single person's issues regardless of nationality, but does every single poster here?
srikondoji, you will also notice that the FBI name check is part of the IV agenda. There have been multiple posts regarding this. There is even a headline currently posted on the front page about this very issue.
