It i svery hard to make predictions because of the possible distortion in the trend due to the new NC>180 day rule.
If you know Process Control, we need to wait for it to settle down for at least 2 more months (by June) before the trend starts to normalize.

Ok I am (for some odd reason) done with my next volley. I think I have ADD because I always get really frustrated after about an hour or so. But surprisingly I spent some time on this one.:D Oh and just to let everyone know those wings are hand drawn.:D I love my Wacom pad. Hehe.

I am still waiting. I created a SR and reply was to wait for biometrics. I am going to India in dec. Any recommendation on what to do if I still have not got the card?

According to the USCIS rule-making agenda, the USCIS is to propose to terminate current concurrent I-140 and I-485 filing. The proposed rule is scheduled to be published in March 2007 with 60-day comment period. It is thus not imminent, but in the later part of next year(Oops!), the immigrant community may see a totally different filing procedure including electronic registration and filing just like current PERM labor certificaiton application procedure. Once the concurrent filing is terminated, the immigrants may experience a terrible pain as related to maintenance of nonimmigrant status pending I-140 petition, eligibility for 245K benefit, plus unavailability of EAD and AP pending I-140 petition, AC-21 180-day portability, etc. etc. Should the I-140 petition processing be dragged, the pain will be extremely unbearable!

dpp: did you open a SR or contact USCIS that you think might have expedited your FP? Also, what was the timeline of your case Xfr from CSC back to NSC? Also, is your FP scheduled at an ASC in CA Bay area? Pleasr provide more information.
I have got FP appt notice 7 days back. I am July 2nd filer, filed at NSC, but transferred to CSC and then back to NSC. Also, got AP and EAD approved long time back from CSC.

I agree. This is one of the easiest things we can do right now. Yes, I mentioned by name, address (along with apartment number), phone number. I did not mention my email address, as it is visible in the "from" field of the email.
However, I was thinking about this approach later. I thought it would be MUCH more effective if we could get others to write to the media/ congressmen/ senators etc... including people who already have GCs and citizenships. The more people convey their resentment to this DOS/ USCIS decision, the more effective it is.
Also, we should preferably also write letters... not just emails.
Emails is a somewhat frowned upon medium, as it is easy to abuse. Also, it is easier to simply delete an email thinking of it as spam... that is, if the email is not already blocked/classified as "spam" by the recepient's email software. (e.g. My yahoo mailbox gets tens of spam emails everyday and they are moved automatically to the spam folder.) On the other hand, it is not equally easy to ignore 1000 "letters" on the subject (preferably signed personally, but even otherwise).
But how can we get others to write letters for us?
Obviously no one will do that... but what if, I "write up" an appeal into a word doc, and email it to my friends, relatives, and colleagues in the USA who are either in the same boat (but not part of IV), or already hold GCs, or are citizens. I would explain our situation very briefly in the email... maybe with 5 bullet points. I would request that if they think what happened is wrong, the they may please write their full name & address + phone num in the space provided in the word doc, and send the document back to me by email. I print these documents and package them up and "post" (snail mail) them to the congressmen/senators and the media.
I am not suggesting I would stop writing "emails to media contacts" (or calling up/ meeting our senators). This will be in addition to that effort.

My employment offer letter has everything but the job duties but the job duties I can get from HR at anytime. In fact we have automated system that can generate all these in a PDF that the HR person can sign.
I am thinking that combination of offer letter, Job verification letter signed by HR, last pay stubs from previous employer, AC-21 memo and a cover letter explaining the portability provision should be enough.
The problem is my attorney is insisting that the letter that they sent for my employer's signature is "required" to successfully respond to this RFE. Is it really true? I have seen other posts where IV memebrs sent a very simple EVL and stuff.

Try DCU,US Bank,ING, and may be some more. I have taken loans from the latter and they gave me 6% for 5 year ARM although it was in 2006.
Try to call them and find out if you can get good deals. Also try to contact Wachovia or Washington Mutual. Please don't just take their words as the process may involve many hidden fees,etc. I think this is true with any financial institution unless we clarify it.

Hey folks,
The proposed bill to give green card to PhDS does not include all the PhDs. PhDs listed as STEM(Science engineering technology majors) are only eligible through this bill in current form. Graduates from pharmacy, medicine, veterinary medicine, animal science are not listed as STEM. I am sure there are many more majors not listed as STEM. I think we should write a letter to congressmen about this anomaly. And I encourage non STEM PhDs to represent their concern so that we can unite and represent our concerns to the congress men. immigrtion service department has listed the subject codes fall under STEM.
You have to browse through the following link to see code for your major. http://nces.ed.gov/pubs2002/cip2000/ciplist.asp.
once you know the code for your major you can go to http://www.ice.gov/sevis/stemlist.htm to check weather your program is listed there as STEM.

You yourself willingly knowingly signed G28 form and gave all the power to your attorney. USCIS is not suppose to be sending you anything. And IV has nothing to do with it.
You have to realize, that your attorney/employer have to be willing to support your GC honestly, since you might need them in case of RFEs, etc. If they are playing games, then invoke AC21 and leave them.
You can sign G28 with another attorney, and your new attorney will request your case from your previous attorney. Your previous attorney will have to be REQUIRED to send ALL your papers (including that RN).
You can apply for EAD with just having receipt number, you can find out it by just calling USCIS. So I don't see any reason to freak out.

I did. Changed to same/similar job (exact same description). Old employer not revoking I-140. lawyer has asked me not to send AC-21 letter to USCIS, wait for the RFE, if any. so sitting tight.
Moved from H1 to EAD.

I got my FP apt on 12/14. There was no lud on my 485. I had opened SR for fp in october, but didnt help. Then I used the POJ method to get hold of IO at TSC on 12/7 and she created one for me, the notice date on FP says 12/7. Hope this helps.

So, does that mean there's no need to invoke AC21 after you get you get EAD, if you want to change employer before 180 days of your filing?
if you change your employer within 180 days of 485 RD, the employer can revoke your 140 which will invalidate your 485.
After 180 days you can switch using your H-1 too. The EAD is not necessary.
