People who left employer early or want to leave early will say it is ok; because it suits their needs.
People who plan on staying later or don't have any intention of leaving early will say to stay.
Bottom line is it is upto everyones own risk tolerance. I have just seen some of the biggest cowards in terms of immigration all of a sudden get so brave after they got the greencard.
If people are waiting years and playing it safe then what is the possible harm to wait a little longer and not get riled up by every small story of someone who got questioned at citizenship time, etc.
Immigration laws don't change very often; however, uscis interpretations and memos do change quite frequently. When you have to start hiring lawyers, go to court, face uncertainty then we'll see how brave people are.
Thank you for all your input. Again, I got my GC on the first week of July and my wife was applied for 485 last July 30. Whether to leave my present employer or not has become a big question as my employer has decided to transfer me to another location in less than a month's notice which showed lack of consideration to the welfare of their employees as they're not only doing this to one person but a lot others too.
My greatest concern now is if leaving my employer would have an implication on my wife's pending AOS.

Yes the service center will send your employer a curtesy copy and attorney the origial approval. Once you get the Feel bill letter and send the cachiers check, they will create a case and send the packet 3. in which you can find the NVC case number.

Hi,
I've been reading about iv.org on Rajeev Khanna's immigrationportal.com since last few days. I just enrolled and contributed a little something thru Paypal. I am however curious about Rajeev Khanna and his office's role in this new org. Leaving aside costmetic details - the forum is more than similar to the forum on immigrationportal. Please excuse my ignorance here - both websites could be using something readily available, but I would like to know if both sites have common administrators.

Make sure to write it as if you are a representative (member) of Immigration Voice and mention ImmigrationVoice name a few times in the article. Write aboout what immigration voice is doing to solve this problem and how this grassroots movement has grown nationwide and will enable a change in the broken immigrationsystem for high-skilled immigrants.

Yes I am looking at the thread. I am expecting a very good forward movement(At least to 2007 Dec) in EB2 India category in the coming months.
If you see the Visa bulletin Archive for the last three years during April - Jul range theres a sharp jump in Priority dates(more than a year and more) for EB2 category. This happened during vertical fall out (This doesnt include last year because last year its horizontal fall out). So this year I am expecting the cut off dates will move at least two years ahead for EB2 India because of the horizontal fall out. For Eb3 I am not expecting any big change unless theres some immigration reform in the new OBAMA government.

On a similar note, I just learned that my lawyer filed my application today. Her reasoning being very similar to that of Vin_a_99’s.
I am one of the skeptics, and do not believe this lawsuit will do any good from CIS front, but I will throw my hat in the ring as I believe at the very least this will bring our issue to light.
On a side note, since my application is filed, I am now eligible for company reimbursement for all my expenses…great news and its Friday…lots of pints coming up.:)

I hope that this holds good for existing GC applicants too. When perm was introduced the existing applications was pushed to the BEC black hole. Many of us had to wait for a couple of years while watching the newer perm applications getting approved.

Big corporations do a very good job in accommodating minorities and racial diversity. We had number of special classes to understand Indian culture when we started outsourcing. Some companies have diversity councils and they meet regularly to discuss issues or topics of interest.
I agree with some one's suggestion here that cosmopolitan cities are better than interior places where they don't see many people from other countries.
Many of my colleagues like Indian food but I will be selective in what I eat at my desk. As much as I like it, I Don't bring spicy Biryani to work.

I have lived in Nevada before. I think in that state and many other western states (where guns laws are more liberal) you have to have passport, I-94 and utility bills proving you have lived in NV for 6 months. That's it. You don't need hunting license to get a gun license.
Here is the biggest irony:
IN order to own a gun, FBI needs only 2 days to check your background.
IN order to get 485 approved, FBI takes months or years to do a background check.
I guess green-card is a more lethal weapon than a handgun.
There are federal firearm laws and then there are local (state) firearm laws.
State laws can be more restrictive than federal laws (atleast when it comes to firearms), but never less restrictive.
Federal law states that non-immigrants (even AOS) are prohibited from owning firearms unless they fall under one of 4 exceptions, the easiest one being the hunting license exception.
If you have a valid hunting license, issued anywhere in the United States (you could live in NV and have a hunting license from NY) you are okay on the Federal level.
After you have met that exception, you have to check and see if your state has additional restrictions.
Some states don't discriminate between citizens/non citizens when it comes to firearms, some do.
e.g. in MA, non-citizens (even GC holders) are only allowed to own non large capacity rifles and shotguns, which means no handguns, and no large capacity rifles (ARs, AKs and the like).
Logiclife, yes, there are some cases where a non-immigrant accidentally manages to bypass the hunting license requirement. This can happen in states which issue their own non-citizen permits. The applicant gets the 'non-citizen' permit and thinks that he/she has done their part and is now okay to purchase/possess a firearm. This is somewhat of a loophole that every non-immigrant buyer should be wary of and absolutely avoid. Sometimes the NICS background people can also approve the transaction without realizing the non-immigrant situation, but that doesn't mean its okay, I have confirmed this with the ATF on the phone.
Getting a hunting license is not difficult though, passing a simple hunter safety course is all that is required.
That being said, I am very pleased to find responsible and safe firearms enthusiasts on this forum.

I have noticed that most "overzealous" CBP officials are found in smaller airports. Large airports like JFK, DC, Miami, SFO etc have efficient and effective CBP officials - they are really busy doing their jobs and don't have time to overdo their job.

Not appeal but rather re-filing as a fresh 140. The labor doesn't expire as long as you had filed an i-140 in the past when the labor was valid.
So i am going to talk my lawyer about it . we might have to change our approach this time.
Just want to clear about path. We will file again and they will denied again due to 3 year Bachelor then we will appeal and show the case reference

the combined study was. As long as foreign masters equals us masters then that is all which needs to be proven."

Correct, there are problems with the online status with TSC.

This will be a class action lawsuit which means that all the people who are in the same class as the plaintiff will get the benefit of the favourable decision. Now on whether to file or not, it is an individual decision but most of us have already prepared for the filling so there is no harm in going ahead with the filling. The worst will be to file again but nothing more than that can happen and as I have heard most of the attorney will not be charging again when people will be refiling their cases. So better to file your case and let USCIS reject rather than feel sorry later on if the judge rules in favour of the lawsuit.

I am not sure about this but one thng can certainly happen with Admin Fix.
Porting of applicant who have stayed long enough in (EB3 to EB2). EB3 15 years experience and still counting and stuck and uncertain porting rules and AC21 doesn't make sense at all.

After apology/providing GC, they are going to provide settlement assistance as a welcome gift....
Right!!! and in the future bulletins, the dates will continue to move to the future and all the FOBs will be forced to take the GC at the POEs else they will be denied entry into the US of A.
