I and my wife are debating whether to apply OCI or PIO card for our son who was born in US and has a US passport. We both hold Indian passport.
Can you experts please suggest which is the better route? The Indian consulate phone number is of not much help. It just keeps going in infinite loop and does not connect to a real person.

I completely agree with you. However our problem is 'how do we organize a massive protest". IV is a loose affiliation of people affected by the immigration problems. They all realize the importance of fighting, however majority of them are unwilling to contribute personal time/money/energy for this cause. Flower campaign was first time in recent history, when legal immigrants showed some unity to express their anger and frustation.
It was predicted that once 485 is filed, people have EAD, and spouse working ... affected people will loose the apetite to carry on the fight. And that's what precisely took place. The biggest chellange is to let the affected people realize that if they do not come out and fight, no one will take care of their interest. It seems everyone is waiting for others to go out and fight, so that they can reap the benefits without any struggle. Now tell me my friend "how do we organize a massive protest??"

There is always some activity or the other going on in the state chapters, in fact in our chapter we organized some law maker meetings in DC this week and some members attended the meetings.
Lobbying is a very effective tool and the more the numbers and support, the more effective lobbying works out.
I would strongly recommend that the members join their respective state chapters and organize grassroots efforts.

In short, what I am trying to say is members are doing what they can in these tough times. Definitely they can and will do more if we have some directions or flexible campaigns.
we have what we have in terms of participations, donations etc ..why not have an easier campaign (flower/letter) which will get maximum participation and also show that something is happening.
as for media campaign ..sooner or later more confident speakers will come forward (who knows ..maybe many present members are not confident speakers or media shy)

I believe sanju is right to a certain extant. However, I believe it depends upon how much of a close relationship you have established with your clients or per say other clients. Have you done good networking...check out LinkedIn, if not. I can guarantee that if you were to go alone...you could easily ask for at least 110-130/hr, however you may not be able to get the $180/hr, since the companies like IBM, Accenture, Deloitte have an established brand name.
This is something these firms have developed over the years. You will be competing your skills and your relationships versus their combined skillsets and knowledge database, their legal backings, their relationships (not just money) and their history. People are ready to pay for a Cadillac because it is a brand name, while for a Ford they willl not pay that much money.
The key is the relationship and the trust that your client will have with you, rather than your current company....if your company has a bigger and better relationship, you will have a herculean task of removing that and replace that with yours, by proving that you are worth the money. Once you establish the brand name and expertise and the legal backings...you too could get may be $140 or so, but will never be able to reach the $180 level.......This is the industry.

My kids didn' go to day care until they are 1.5 years old, then they want to babysitter , they started going to day care after 2.5 years. Day care is right place for kids after 2 years, because they need other kids to play, staying home is boring for them. I have personally experienced this.

My wife has a H1 since oct 2006 till date she hasn't worked and hence has no pay stubs. her passport has a F2 visa. I want to convert her visa to H4. Her employer is asking for 6k to generate 3 paystubs for 3 months. I dont want to pay so much. if we go to canada to get H4 stamping will they ask for her pay stubs or just my pay stubs are enough.
Is there any chance of rejection. also can I go to canada for stamping or do i have to go to home country.
is there any site or posting that explains the process of applying for H4 in canada.

I am in a unique situation and your valuable advice is highly appreciated. I worked for company A for 3 years and filed my 140 and 485(july 2007). I quit the company in may this year and joined another company. My 140 was approved on 06/16/2006. recently my previous employer revoked my I-140. I got a notice from USCIS that my I-140 and I-485 has been withdrawn. As per my new attorney since i meet all the conditions for job porting (180 days, 140 approved, and same job profile), no one else other than me can withdraw my I-485 application. my attorney filed an MTR today. Can i work while my MTR is pending. Is Withdrawal acknowledgement notice is same as denial notice ? please help

Also, when someone does not support your theory, he/she is actually supporting you, by letting you know that your theory does not sound reasonable.
Contact a Taiwanese/Asian lawyer and ask him to help you. You can add him as a lawyer, and even if you are replacing your lawyer, and if asked, you can claim language barriers with the old lawyer.
And no, we are not experts here, and no one has claimed to be one, but I believe the real purpose of yours posting your situation here was to have ideas. There are thousands of thoughts going thru your mind on this situation and you are definitely not able to see thru clearly.

As travelled much between Asia countrys, no much time staying is US office although I based here. Yes, my English is poor and broken but this is not a fake story, make no sense for me. Now the negative point is mostly from my statement, no matter whether you believe, the attorney told me drag with anger is battery. we think that's okay does not mean it is okay on the law. So I wish you guys be careful on this kind of play around to avoid any trouble. I knew you all have better english than me. so you could explain clearly :) But Same level, do it on your spouse is even worse on a stranger.
I create this thread just wish listen your opinion and try public view how much chance I can win the jury trail. Some of your advice is really helpful and I will take them.

If both of you are Indian citizens then your only option is PIO as OCI needs atleast one parent to be a US citizen.

I am EB2-I with PD of Aug 02, still waiting for approval of 485. July07 concurrent filer. 140 was approved in Sept08.
And this is the interesting part. The online status still shows 140 as pending. No email either, just a soft LUD on the online status. USCIS is being truly erratic. A maverick?
You should fill out a form with the Ombudsman. Just google for it. They should help you with your case.
Is your NC cleared? Have you taken an infopass to confirm your biometrics and NC is all clear? There have been cases where fingerprinting was done but it wasn't reflected in the case status.

Those of you who are now thinking that being able to file 485 will give you freedom - just read through the list to see how many 485 filers (mainly Indians and Chinese) are stuck in the name check russian roullette.

Most would think it would catch moslems - in reality it catches anyone in "hi-tech" and more often than not Indians, Chinese and Russians. And ofcourse Koreans too. One of the person's stuck in name check commented on the above link - if the FBI knew that a fifth of the nation shares the last name Kim! I guess the same would go for Wu, Yu, Zhou, Singh, Kumar etc.
