Guys, what about July 2007 filer. I filed my 485 then without my wife's name as she somehow could not join me then. I am hoping that as soon as my dates are current, I'll immediately file my wife's 485 on the first day of the month. Hopefully that should include her in my app before its approved.

I-140 PP is only available if you are within 60 days of your H-1 capout. So for most people who are porting PD from EB3 to EB2 , there is additional wait of six months to an year just for I-140.
Porting PD from EB3 to EB2 can easily take 1 year including new PERM application, I-140 and I-485 interfile.
What is interfile ? Is it changing the underlying I140 for the 485 application ?
Can we do that ?
Can the new I140 be from the same employer or does it need to be from a different employer ?

Guys,
Finally my problem and my questions are solved.
I drove up to the Canadian Border near Niagara Falls (Buffalo), they Canaidan Border Officials took my I-94. I took a drive in canada for 10 minutes. I even stopped at spot to view the Niagara Falls from Canadian side and drove back into US. I was issued a new I-94 with out any additional interogation.
What surprised me was my Canadian Visa expired on 09/01/2007 and i was still allowed to enter into Canada.
Anyways Thank you guys for all your responses.
I am kind of relieved related to my issue related to I-94.

Good it all worked out for you. I am sure they stamped your passport on the way back into USA. Just keep track of your intrnational travel at some point it might be required, you might loose track of them if you don't have exit or entry stamps on your passport.

Get your facts straight. "Undocumented" does not mean a person who has "lost" his documents....it means a person about whom there is no record (i.e. documentation) at the USCIS/Dept. of State. A legal immigrant would not become out of status just because he lost his documents or they were destroyed in a flood or fire because there are typically copies and records available at the employer, the IRS, the Social Security Administration and the USCIS. A person who has all his documents would still be classified as illegal if he or she overstays their visa.
Anyways....please do not try to hijack this thread in a different direction than what is intended. After a series of hearing by the strongly enforcement only leaning house questioning each and every aspect of the CIR with negative connotations, finally, there is a hearing organized by Senator John Cornyn, who was instrumental in getting the SKIL bill included in the CIR focusing on something positive and fairly non-controversial in the CIR/SKIL/PACE bills and that directly affects all of us legal, documented, high skilled immigrants.
SO, to bring the thread back to its original intended path...Are there any members in the Dallas or nearby areas who would be interested in attending the hearing, please contact himanshu at immigrationvoice.org The hearing is scheduled for tomorrow.

- You are a dependent EAD holder
AND
- You will never need to travel outside US
AND
- Some one else takes care of renewing your EAD every year
AND
- Someone else pays the $340 + $200 (lawyer fees) to renew the EAD
AND
- The principal applicant is able to find job in "same or similar" if laid off so that I-485 is not jeopardized
AND
- You are never going to get laid off because if you are, then good luck, because there are lots of companies out there that explicitly require green card holders and citizens because they don't want to get into any type of immigration issues (illegal by law, so you can technically file lawsuit against them).
AND
- You will never need to travel outside US
AND

A 700billion$ bailout is not helping much. You think we can help the economy? We are at the mercy of the employers whose earning results are going down because of recession. :( It is hard for me to believe that we can help the economy by buying houses and how are the law makers going to get convinced? Show me the proof.

Let me take example of India: I heard someone talking India coming with Rs. 100,000 Crore (US$250 billion) bailout, some other said no it is Rs 60,000 crore. Between these talks, one airline asked for Rs 5,000 crore bailout. So follows other industry.
So now this is economy of bailouts. I am sure several other countries also must be planning bailout. US has $10.2 trillion US national debt (FED loan), but current external debts are too much (US$16.2 trillion in 2006 ) and govt liabllities US$59 trillion. US economy desipte problems is so strong that all the bailouts directly or indirectly supporting business in US. So the US$700 billion is just a symbolic figure. Actual support to US economy could reach US$ 4-5 trillion through worldwide bailouts.

unfortunately you can't speak to anyone over the 1-800# at the Service Centre. Your boss/employer only has to call the service centre and follow up as to what is happening with the case..otherwise you r losing each day with no result...
either the RFE is complicated for which your boss doesnt want to callup INS r what follow up with them..if i94 expires beyond 240 days you will be in more trouble

Can we do something about this.
Maybe we can go to a federal court saying it is discriminatory and get a ruling to that effect. This would stop "any" state from coming up with such legislation.

We have too many items to worry about. DL should not be one of those.
In this country one cannot work without a driver's license. It is a matter of human rights. When USCIS gives us work authorization that has only 4 months remaining on it, a state ( Texas ) cannot say that I am not eligible to drive in this 4 months.

Isn't it something similar that happened when Gandhiji was thrown out of a train is South Africa. Gandhi was discriminated based on his color. We are being discriminated on immigration status for our right to work.

Okay I liked code, contagious, and serif. Serif has my favorite palette of colors. Love the detail in the contagious one. Background is a little bland though. I voted for code though. Has the same colors I like.
All I got to say is Timmy Tots would have won. I can picture it now. Pixel font in the middle of a canvas. Can't compete with that. Maybe even a neon font on a black background. I should have competed in this.

Call USCIS and get your reciept number. Simple as that.
Some employers won't provide us the receipt notices for our I-485 applications. Yeah, it is supposed to be OUR application but that's how they play this game. Attorney refuses to release the RNs without employer's permission.
If we don't get our receipt notices, can we still change employer in 6 months using AC21. There must be a way out otherwise these suckers have an easy way to bypass AC21 laws...

Latina: If you are correct then, since it is mentioned in so many posts that IV should achieve a non country quota, it should be clear for us (Rest of the World) category that this won't affect our waiting time; because if you are right that the Sernior voices were never advocating that the Worldwide Category will suffer any delays, it gets confusing after reading so many junior posters talking about not having a per country quota (just one line), that for newbies like me it is not crystal clear, of course I am all for the unused portion of the numbers for Worldwide category going to skilled immigrants from non worldwide rather than to anybody else.
