Those of you who are now thinking that being able to file 485 will give you freedom - just read through the list to see how many 485 filers (mainly Indians and Chinese) are stuck in the name check russian roullette.

This is one of the biggest bottleneck to 485 and naturalization processing. Most would think it would catch moslems - in reality it catches anyone in "hi-tech" and more often than not Indians, Chinese and Russians. And ofcourse Koreans too. One of the person's stuck in name check commented on the above link - if the FBI knew that a fifth of the nation shares the last name Kim! I guess the same would go for Wu, Yu, Zhou, Singh, Kumar etc.

Figures suggest that there are over 800,000 pending applications. Recapture will get around approximately 215,000 green cards. We are shot of around 600,000 green cards, which will take around 4 years (@140k/yr EB green card) to address the current backlog, which contains your and mine application. This is a deep deep hole and EB3-I is at the bottom of this hole.

Why the bloody hell are you guys judging him for what he has done? He only asked for some advise regarding immigration implications of his situation.
I do not think any of you who is beating him down like this has any right in doing so. I bet that each and every one of you have done more mistakes than Mr.Sahaayam did. You just were never caught. You must have done more filthy things than 'shop lifting'. I'm sure you have all lusted after women, watched porn, frequented strip clubs and drank a lot of filth. What makes people think that USCIS has preadjudicated cases in the order of priority date. If they have preadjudicated cases from 2005,2006 and left the cases from 2003 -2004 then it is the same mess an d i can bet that knowing USCIS chance of this are very very high so even if your date gets current it is still luck whether you get GC ornot.

Great job guys! Keep up the good work. The article has given much needed exposure to the problems of Employment Based Green Card Process and the plight of skilled workers from India and China. Sorry to hear this. Regarding medical insurance, your company has to offer you COBRA..you will end up paying almost twice the premium that you have been paying so far, but it would still be better than you footing the delivery charges (10k - 25K). Continue CORBA atleast till the deliver and post-partum - for as long as possible..
Terminating you in your ninth month pregnancy is probably against the law, i think if you can prove it, you might be able to sue your employer, check your local state laws..

If my priority date is retrogressed at the time of processing my EAD and AP, will USCIS keep the EAD and AP on hold? Or will they process EAD and AP and hold the I485?

Thank you very much for all the response. I waited for responses from different places so I could determnine if it is a Nationwide policy as what the Colorado was saying.
I am from Colorado and I think Colorado is one of the strickest states in the US whatever.
It looks like from responses that only Colorado has so far adhered to this new policy.
I have 4 friends who currently cannot drive because their licenses have expired and they are waiting for MVI's (Motor Vehicle Investigative Unit) letter. Until such letter is issued, you cannot renew your license (in Colorado). According to MVI Here, it will take to 5-7 days, but if there is a problem, it will take up to 9 weeks.
Really rediculous procedure and I agree with everyone.
Just in case anyone there is in the same predicament, please share your story and the resolution.
What we are seeing here is the uneven implementation of the REAL ID act passed by Congress last year. The act gives upto December 2006 or March 2008 (I am not sure which) for all states to have an uniform process in issuing DLs. Essentially, what it means that once the act is fully in place, no one, be it an American citizen or a immigrant can get a DL on the spot. They will take your SS no and other documents (i am not sure about what they actually require) and run it against the USCIS database to confirm your legality. It might take upto a week or a month to get your permit in the mail. The act also puts a limit on the maximum validity of a DL which cannot be more than the date on your visa. In the meantime, I guess they will be issuing you with a paper permit allowing you to drive. It all sounds nice and hunky dory to read but the problems are numerous. First off, the entire onus of funding this federal mandate is put on the States. Many states have already lodged their protests against this requirement as it will mean them having to increase the fees significantly. Secondly, the act assumes that the SS database and the USCIS database is up to date and has no flaws. Thirdly, it assumes that the chcks against the databases will have a fairly quick turnaround time. We all know how laughable these assumptions are (FBI FP check victims will appreciate this).
The REAL ID act is another of those great ideas that have been rammed down the throats of the American public without suffficient debate similar to the HR 6061 that was passed by the house leading to the whole CIR fiasco.
Hopefully, as time goes by saner minds will prevail and the act will either be repelled or modified to make it easier for genuine people to get the DL quickly. In the meantime, get prepared to face another bureaucratic and government created retrogression :(

I can categorically state that once a category retrogresses, any I-485s with PDs later than the cut-off date DO NOT get approved.
This happened to 1000's of us in EB3 in 2005 when EB3 RoW became 'Unavailable' after we had concurrently filed I-140.
Now, this does not mean that processing stops (I got 2nd fingerprinting, etc), it just means that the I-485 cannot be approved until PD is reached. Since my PD (03-may-02) has now been reached, my approval is mere weeks away --- because processing continued up to the point of approval.
Now, Schedule A's of course, benefit from being able to look at TWO categories (Schedule A and either Eb2 or EB3, depending on how their I-140 was slotted). Whichever of these has a cut-off after their PD, will be the category they get approved under.

Did someone try to call the number listed in the bulletin as it says that the cut-off dates are available on the phone too. I tried that and it is still saying Aug bulletin.
