    For EB3 (All countries) to see some light, the changes made recently to the allocation of excess visa, spill over and also to over subscribed countries need to be revisited. Not sure, what triggered USCIS / DOS to revise the interpretation after so many years. Did IV had any role on this, or not .. do not know.. I ask this as based on all forum updates, IV appears to have little success in the Admin Fix area. I have posted this so many times in various threads and did not get an answer, may be there is none. If the interpretation was somewhat like before, EB2 /3 both would have got the spillover... and all would have benefited in the order of PD. Now with the new interpretation. all excess / spillover visa just goes only to 2 countries (EB2 India / China). Looking at the latest numbers based on USCIS website, China has far less cases compared in India based on the cut-off date, which is good for India (EB2), as they now consume a big chunk of the numbers and rest are left out for now. I am not sure, what is opinion on this from folks from ROW (EB3) on this. Does IV has any comment on this... Having said this, I have nothing against Eb2 or EB2 India specific, and not getting into the argument whether or not EB2 need to given much preference.. (Well DOS allocated on 28.6% of total numbers to both this category). This is just my concern on the changes to interpretation for the visa spill over process.

    Dude my labor was filed in march I do not have it approved as yet!

    I have been trying to find the latest CIR thread by Pappu (where he talks about it being introduced) from last week (or the week before ?!) but was unable to locate it.
    Could someone please point me to that ? No matter how bleak the chances are for it's passing, I would still like to follow it since it's our only hope at this moment.

    DOS allocates GC numbers to USCIS adjustment cases only as the point of approval is reached. DOS can set/move/retrogress PD based on info provided by USCIS about number of cases at point of approval.
    USCIS is not able to provide a good estimate of this number because

    it can not calculate this number based on USCISs workload, and
    it does not know the number of cases DOL will send to them. DOL again can not calculate the number of cases (it will send to USCIS) based on DOLs worload.

    The key to addressing this management issue at USCIS is to understand the dynamic interplay of priority dates and shifting workloads of three departments, and to know with greater precision and accuracy the size and details of USCIS� workloads.
    The tri-agency meetings seek to expand inter-agency communication regarding expected new demands and surges, workflows, and priority dates. During the meetings, there is an examination of the case management systems and data collection processes used to assess workflows through each entity, particularly USCIS.
    Although USCIS stated in its 2006 Annual Report Response (at p. 8) that it provides detailed data to DOS, the tri-agency group identified gaps in USCIS� data.

    One more thing along the same lines, what will happen if my friend gets his H-1B through non-profit organization and will want to move to a profit organization? Will he have to again wait untill the regular quotas kick in? In other words can he simply transfer his H-1B to a profit organization at any time of the year regardless of the availability H-1B visas in the numbered-cap/quota system? Thanking in advance,

    USCIS does not differentiate US or Indian degrees.. Yes US degree has its own advantages... It more than just LEARNING...

    Education is a bigger word than learning... Institutions can impart learning only... You can be highly learned with big degrees... still not educated :-)

    Take a chill pill friends... Degree is important to USCIS like MPG (miles per gallon) to Car.. as its a basis to compare different entities :-)

    I am applying for H1 visa from India this April. I am coming to USA on H4 visa in June.

    How do I transfer from H4 to H1 in case If I my H1 gets approved? I heard since I am applying from India, I will not get I94 along with my approved H1 papers.
    So I will be on H4 I94 only.

    I think spillover method has not been changed since years. The only puzzle is that whether it is horizontal or vertical or combination of both that USCIS works with we exactly do not know.

    Do you guys agree ?

    In my opinion equal share of spillover count to oversubscribed EB categories for a particular year would be the final and legitimate solution.

    We are hearing from multiple sources that, on Monday or Tuesday of next week
    , State Department plans to issue a revised Visa Bulletin for July 2007.
    This revised Bulletin would retrogress some or all of the employment-based
    categories, very likely to the point of unavailable. Reports from AILA
    members about unusual levels and types of activities by USCIS indicate a
    particular push to adjudicate employment-based adjustments currently in the
    pipeline so as to exhaust visa numbers for fiscal year 2007.

    This follows the actions of USCIS in June, when it began rejecting EB-3 "
    Other Worker" adjustment applications even though the Visa Bulletin showed
    an October 2001 cut-off date, on the basis that the "Other Worker" numbers
    for the year had been exhausted.

    Can anyone tell me how long does it take on an average to prepare an application (advertising, waiting for responses etc) for PERM? Also, the 30 days waiting time for response....does it include weekends or is it 30 business days?
