This date movement could also be to silence amendments like Cantwell's which are based on Backlogs. A parallel GC system to Point based was called a poison pill by Sen. Kyl. I guess may be this is a way to lock up one of those pills. Could be Chertoff's trick to mine-sweep the path for CIR.

EB2 LC Priority Date: August 25, 06
I-140 pending
Received I-1485 receipt notice and EAD
I-485 Reciept Date: August 1st, 07
I want to do an internal move from the position of "Software Engineer, Test Automation" to "Software Engineer, Webapp Developer". The job duties are similar but not exactly the same. Also, the job qualifications for the first job required BS + 5 (which I don't have yet) or MS (which I have). My company specifically made it this way for me. But the job qualifications for the new job is just BS + 3 (this is apparently not EB2). But now they are not willing to change the job qualifications for the new job to be EB2 since they have to do recruiting/advertisement reports, etc. for the new position.
My lawyer says its illegal to change job duties w/o notifying USCIS. They say I cannot do that even with an approved EAD. Is this true? If so, is there any USCIS documentation backing this.

Do I see any update in online status of my I485, If USCIS sends me FP notice. Filling date is July 10th. I received everything else (Receipts, AP, EAD) but FP notice. If I call USCIS, do they help me find my FP notice status??? Please help...

possible reason for mysterious rejections :
You are a mail room guy, you go home friday (06/29) and comeback on monday (06/02).
You start the monkey business of timestamping incoming mail, but half an hours into the day (around 8 or 9:00 am), you realize "sshhttt: i did not change the date on my stamp, its still read 06-29-2007". In the classical govt. fashion, you do not bother to go back and restamp the applications with the correct datetime. Not because you are evil, but because you simply don't understand the ramifications of early stamping. You think u are doing the guy a favor, putting him/her early in line.. but guess what... the guy's application is gonna get rejected.
Could this be the case with some apps mysteriously being rejected?

I wonder the reasons for Switzerland to be #1. Its a small country with minimal immigration and not much resources. Key revenue might be from Tourism. They are not known for scientific work etc.

I got FP notice on 8/14 with appointment date on AUG 31. My application received on 7/2 and notice date of 8/2.
NSC sent the notice to me and to my attorney.

Dude,
Take your company attorney & HR guy(al) out for a $250 lunch and first build a rapport with them. Tell them about what you need & do tell them politely that if they care about you as an employee, they need to get on with your immigration process.
Nothing unethical, illegal or embarrassing about push your point forward.
There are ppl who will tell you that sth like this would never work. time ot prove me wrong!
Its your future. Take charge.
Haha. That is an accurate assessment at a 50-foot level. I was pretty disillusioned after a couple of years of working. A mixture of what the fuck am I doing, but not really knowing what to do, and all confused because I was at probably the biggest firm around and and a feeling of even if I switch, what's the point? And not having the balls to switch jobs, for the fear of throwing away what I had, mixed with personal struggles with life and not having the social life that I wanted.
In between all this, the desire to get the GC process kicked off came and went, esp. since I wanted to switch positions to a more people oriented role, and the feeling of gosh, do I want to stay in 6+ years in this job - maybe if I file, then I won't want to change jobs.
As you can see, even I am not sure what was going on there. But my personal life and acclimatizing has sorted itself out rather well of late, and I do want to stay here now that I have a really interesting life (and partly out of fear of throwing everything away and moving somewhere new).
Now, I know that IV is not a self-help trauma group, so I will cut short my story here, which has little to do with the raw facts of my immigration situation :)
And yes, I did not participate or know much about the visa process, or IV till recently, and am a recent need based participant, but I hope that does not stop anyone from contributing their ideas to help me out.
*** Also, to the previous poster (nojoke) who said that big companies usually hold off on perms, are you suggesting that I have a better chance at a smaller company then?
UPDATE: My company attorney suggested talking about this in April, and I am nervous about waiting till then in limbo - things are only going bad to worse, I might as well find a job at a place which will sponsor a PERM sooner rather than later.
I request you to PM me if you have any leads for such companies might still be a good bet for filing a PERM.

My wife will be on H1(currently on H4) october onwards...we received our EAD's yesterday. Can I still go and apply for SSN? I mean will that mean she is on EAD and H1 no longer valid?
In my case my wife was on H4. She had to activate EAD to begin working. For that reason she applied for a new SSN.
Based on my limited knowledge, if anybody activate's EAD and begins working on that EAD, they'll lose their H status. Experts need to confirm this.

I really need to thank you from the bottom of my heart, bcuz this was just the right moment for me to get this piece of information (I was under the impression that although you can keep your PD, you have to do labor, I-140 again.) For some reason, I had kept hearing a lot of mixed messages about AC21.
I just confirmed all this with my lawyer as well.

I have filed 140 and 485 in July 2006, EB2 file concurrent at Nebraska service center. So far no word yet.
I would like to know anyone get approve either 140 or 485 from Nebraska service center to get an idea the time frame on my case.

As all the I-140's from CA and VT were transferred to NSC in April so it is slow. I guess they are currently working on cases filed in the month of April. If your I-140 is not approved by December then you might want to consider converting it into Premium Processing so that you can avail the benefits of AC21 once your I-485 is pending for more than 180 days.

I had seen a similar thread for NSC->CSC->NSC filers, but can't seem to find it anymore---did anyone whose cases got transferred to CSC receive FP notice?
I am a July 2nd filer, EAD/AP approved from CSC, case transferred back to NSC back in early Sept--still waiting for FP notice for over 4 months now.
PS: I am not desperate for FP notice---and i know it's going to be several years wait--just want to get the FP done and move to an apartment with lesser rent :-)

I do not want to spoil the party fun but somewhere in my mind there is a lingering doubt. I read Ron Gotcher's post about August 2008 bulletin.

Ron gotcher makes sense to me. Considering the (quota + spill over) vs. the demand, it is just wishful thinking that all EB2-I with PD < 06/06 will get GC in the next few months. I also agree with others that in Oct EB2-I will retrogress back to the original levels (2004), it could go even beyond (to late 2002 or early 2003) that if a handful of EB2-I (who did not get a chance a last year) file 485 in the next 1-2 months.
2 yr EAD rule and this big EB2-I advancement could just be an unfortunate coincidence. But a lot of folks will sure find a 100% correlation nonetheless.

Had applied on July 19th , receipt date of July 20th.
I never received any receipt notice and today I received transfer notice

Hi,

Incorrect!
One can start working as soon as H-1B transfer is filed, if the beneficiary has (or had) H-1B status in past. Google for H-1B porting.
